캐나다의 지진, 해일 및 화산 관측 관련 법제

초록
캐나다에서는 연방 천연자원부(Natural Resources Canada, NRCAN) 산하에 지구과학청(Earth Sciences Sector)이 있고, 그 하부 부서인 캐나다 지질조사국(Geological Survey of Canada, GSC)이 캐나다 전역의 지진, 해일, 화산활동 등 지질조사 및 지구과학, 지구물리학의 자료조사와 관측을 전반적으로 담당하고 있다. 캐나다는 기상관측기관을 중심으로 하여 지진관련 업무가 시작된 후 지질관측기관과의 기구상의 통합을 이루어 지질조사국을 중심으로 하여 발전하면서, CNSN, POLARIS, 강력진동 지진계 네트워크 등을 운용하면서 효과적으로 지진관측 및 분석업무를 시행하고 있다. 이러한 조직체계를 바탕으로 하여, 캐나다는 지진관측 관련 법령과 관련하여 천연자원부법(Department of Natural Resources Act)과 자원 및 기술조사법 (Resources and Technical Surveys Act)을 제정하여 천연자원부장관의 일반적 업무권한, 자원 및 기술적 조사와 관련한 권한 및 임무 등을 규정하고 있다. 캐나다의 지진대비 건축관련 법규로서 연방차원에서 캐나다 건축법전(National Building Code of Canada)이 마련되어 있고, 이러한 모델건축법안을 바탕으로 하여 대부분의 주에서 내진건축관련 법규를 제정하여 시행하고 있다. 또한 캐나다 내에서 지진 등으로 비상사태가 발생하는 경우 등에 대처하기 위하여, 지진관련 비상사태 대비 관련 법령으로서 공공안전 및 비상사태대비부법(Department of Public Safety and Emergency Preparedness Act), 비상사태관리법(Emergency Management Act)이 제정되어 비상사태 대비 및 관리에 관한 절차와 내용을 규정하고 있고, 이러한 법적 기초 위에서 연방정부는 비상사태와 관련하여 연방비상사태 관리에 관한 정책(The Federal Policy for Emergencies Management)을 채택하여 시행하고 있다. 그리고 주 및 준주의 정부들 또한 비상사태대비 법률을 갖고 있다. 캐나다는 지진관측의 주무부서인 연방의 천연자원부 산하 지구과학청 지질조사국이 중심이 되어 캐나다의 주와 준주 등 지방정부와 서로 긴밀히 협력하여 전국적 지진 관련 입법 및 시스템을 중첩적으로 운영하면서 지진 등에 대해 효율적으로 대응해가고 있다고 평가할 수 있다. 이러한 캐나다의 입법 사례는 우리나라에서 지진, 해일 및 화산활동 등 자연재해의 관측관련 법제를 정비함에 있어서 많은 참고와 시사점이 될 수 있을 것이다.
Abstract
Recently the Korean Government is preparing a bill on “Earthquake Monitoring and Tsunami Warning Act.” This article is a part of comparative studies on the legal systems of foreign countries regarding the survey, forecast, warning and emergency management of earthquake and tsunami for a tentative proposal of the bill. This article is particularly focusing on the Canadian experiences. Canada has long history of geological survey including earthquake and tsunami. The legal system of Canada on this survey is based on various Acts and intergovernmental accords. This article covers brief history, characteristics, related system and institutions of the Canadian geological and meteorological survey including Geological Survey of Canada (GSC), Canadian National Seismograph Network(CNSN). The authors also review and comment on the related laws and legal issues of Canada including Department of Natural Resources Act, Department of Public Safety and Emergency Preparedness Act, Emergency Management Act, National Building Code(NBC), Resources and Technical Surveys Act and The Intergovernmental Geoscience Accord(IGA). The authors suggest that Canadian experiences could be one of the possible examples for Korean Government in spite of many differences of the natural environments and socio-legal backgrounds between both countries.
