장애인의무고용의 규범적 정당성과 제도적 타당성에 관한 연구

「장애인고용촉진법」은 1991년 도입된 이후 지금까지 의무고용과 고용부담금,그리고 고용장려금 세 가지 수단을 사용하여 장애인의 고용을 증시키기 위한정책을 시행하기 위한 기본법으로 기능하여 왔다. 이 논문은 이 중 의무고용을중심으로 그 헌법적 정당성을 밝히고, 정책적으로 합리적인 제도를 형성하기위한 목적을 갖는다. 먼저 의무고용이 사용자의 계약의 자유 및 영업의 자유,그리고 경제질서, 평등권과 합치되는가의 문제를 다루었다. 이로써 의무고용에대한 규범적 윤곽이 획득될 수 있다. 의무고용에 대한 평가와 개선방안에 있어서는 다음과 같이 두 가지 점이 중요한 상황조건으로 작용한다. 첫째, 1990년제도 도입 이후 장애범주가 확대되는 등의 이유로 장애인구가 급증하였다는 사실이다. 둘째, 2008년 「장애인차별금지법」이 시행되면서 이 법상의 차별금지조치와 기존의 의무고용과의 기능분담을 이해하고 새롭게 형성할 필요성에 대한논의가 필요하다. 제도내적으로 보면 의무고용이 지금까지 장애인고용증진에어느 정도 기여했지만 주로 경증장애인에 편중되는 문제가 나타났고, 따라서중증장애인의 고용을 증진하는 적극적인 구상이 필요하게 되었다. 이 논문에서는 의무고용률을 장애인출현율에 근접하게 높이는 것을 가장 시급한 개선방안으로 제시하였다.
Abstract
The employment promotion for the disabled act has enacted a quota levy system since 1991. This article aims to clarify its constitutional legitimacy and based thereupon to give some directives to reform it. The need to reform this act comes from the following two circumstances; first,since 1991 the number of the disabled persons has increased steeply. Second, 2008 the disability antidiscrimination act was enacted, which requires the functional division between this act and the employment promotion for the disabled act. The evaluation that the quota system contributed to the employment promotion of the disabled to some degree,but the severely disabled were neglected against the legal purpose, is an additional, but important reason for the rethinking of the current quota levy system. In this article has been proposed that on the one hand the quota for the employment of the disabled should be increased, on the other hand, the vocational education and training for the severely disabled should be more activated for them either to be incorporated in the first labor market, or protected in the sheltered market for the disabled.
