국제관계에 있어서 아시아의 부상이 미칠 영향에 대한 관심이 급증하고 있다. 21세기는 아시아 시대가 될 것이라는 전망 또한 제시되고 있다. 아시아의 부상에 따라 소위 이스트팔리아 질서(Eastphalian Order)라 지칭되는 아시아의 영향력을 반영하는 새로운 국제질서의 출현 가능성에 대하여 다양한 전망이 제기되고 있다. 이스트팔리아 질서 및 이의 운영체제로서 아시아 국제법은 어떠한 모습으로 출현하게 될 것인지, 출현하게 된다면 어떠한 도전에 직면하게 될 것인지, 지향해야할 목표는 무엇인지에 관하여 관심이 집중되고 있다. 이 글에서는 이스트팔리아 질서와 아시아 국제법의 출현 가능성을 세 가지 측면에서 검토하였다. 첫째, 이스트팔리아 질서와 아시아 국제법의 출현 가능성에 대한 이론적 측면의 검토를 위하여 TWAIL의 의의, 특징, 및 한계를 고찰하였다. 둘째, 아시아 가치론 관련 논의들을 살펴봄으로써, 이스트팔리아 질서 및 아시아 국제법이 어떠한 철학적 관점을 제시할 수 있을 것인지를 검토하였다. 셋째, 인간 중심적인 이스트팔리아 질서와 아시아 국제법의 형성을 위하여 아시아 국가들에게 어떠한 태도가 요구되는지를 검토하였다. 이를 위해 인간안보 개념에 대한 아시아 국가들의 입장을 고찰하였다. 이러한 검토에 따라, 인간 중심적인 이스트팔리아 질서와 아시아 국제법의 형성 가능성은 현재로서는 그다지 높지 않은 것으로 판단되었으며, 문제의 핵심은 주권의 절대성을 고수하고 있는 아시아 국가들의 태도에서 찾을 수 있다고 생각된다. 인간 중심적인 이스트팔리아 질서와 아시아 국제법의 출현을 위하여 아시아 시민사회의 적극적인 협력이 중요한 것으로 판단되며, 인간 중심적인 이스트팔리아 질서 및 아시아 국제법의 형성을 위해 어떠한 방법이 제시될 수 있을 것인가에 대한 지속적인 논의가 필요하다고 생각된다.
Abstract
Interest in the possible impact of the rise of Asia in world affairs has been growing for a number of years. Predictions that the 21st century will be the "Asian century" provide food for thought about the implications of Asia's role in world affairs. Also, various predictions that the rise of Asian will bring about the emergence of an Eastphalian Order, which reflects influences of Asia are suggested. Much attention has been paid to what would an Eastphalian Order look like, what kinds of challenges would be placed before an Eastphalian Order, and what would be the direction of an Eastphalian Order etc. In this article, I have tried to look into the possible emergence of an Eastphalian Order in three aspects. First, I explore the strengths and weakness of Third World Approaches to International Law (TWAIL) for an inquiry into the theoretical aspect of an Eastphalian Order. Second, reviewing debates concerning Asian values, I tried to find out what kind of philosophy will be projected by an Eastphalia Order. Lastly, exploring attitudes of Asian countries towards human security, what kinds of changes would be needed to make Asian countries establish an Eastphalian Order and an Asian version of international law, which is based on the people-centric perspective on international law. My investigation has shown that there is little possibility of the emergence of an Eastphalian Order and an Asian version of international law for the realization of the people-centric perspective on international law. Asian countries' strong adherence to the supremacy of state sovereignty hampers the right direction of an Eastphalian Order. Robust cooperation among civil societies in Asian countries plays a pivotal role in overcoming difficulties made by attitudes of Asian countries towards state sovereignty. Continuing attention should be paid to the analysis that explores the another way to bring about the changes of attitudes of Asian countries' for the formulation of an Eastphalian Order.
