이 글은 1970년대 지식-권력으로서의 법률 담론에 나타나는 하층 여성상을 통해, 당시 지식-권력과 공모한 국가 기구가 하층 여성을 어떤 형태로 통제하고 관리하였는지를 살피는 데에 목적을 두고 있다. 이것은 법률 담론을 통해 특정한 주체성(하층 여성성)이 어떤 식으로 (재)생산되었는지를 확인하는 일이기도 하며, 이러한 담론이 ‘도덕의 담론’으로 기능하면서 어떻게 ‘건전한 국민’을 ‘상상’하는 데에 이용되고 있는지를 살펴보는 일이기도 하다. 1970년대 법률 담론에서 하층 여성들은 국민의 ‘풍기’를 흐트러뜨리고, 성병을 옮겨 국민 건강을 해하는 부정적 존재로 표상된다. 그렇기 때문에 이들은 건전한 국민으로 거듭나기 위해 관리, 규율되어야 할 대상으로 규정된다. 국가는 지식-권력(법률 담론)과 공모관계를 이루면서 갖가지 세밀한 제도적 장치를 마련하여 하층 여성을 국가의 관리 하에 두려고 한다. 하지만 규율하고 통제하려는 움직임 속에는 그것을 벗어나려는 흐름이 ‘함께’ 존재한다. 당시 일간 신문에 실린 사건들을 통해 확인할 수 있는 것처럼 담론과 제도적 장치를 통해 하층 여성을 관리하면서 건전한 국민을 만들고자 했던 국가의 기획은 저항에 부딪히게 된다. 하층 여성의 특성을 자기 식으로 규정하려 했던 1970년대 법률 담론에서 확인할 수 있는 것은 권력 담론의 폭력성만은 아니다. 여기에는 통제가 쉽지 않은 하층 여성에 대한 불안과 공포의 징후가 드러난다. 1970년대 하층 여성을 재현하고 있는 지식-권력으로서의 법률 담론은 그것이 견고한 것처럼 보여도 사실 균열과 저항의 흐름을 힘겹게 봉합한 불안정한 것임이 드러난다.
Abstract
This article aims to investigate the way nation-apparatus manage the female subalterns in 1970s. Juridical discourse as the knowledge-power shows how nation-apparatus conspire with knowledge-power and control the female subalterns. Through these discourse which function as ‘moral discourse’ at the time, we can understand how they represent the female subalterns and how they use to imagine ‘the sound nation’. They represent the female subalterns negative images. In these discourse,the female subalterns disturb public morals and ruin people’s health through transmitting sexual disease. So they are characterized the targets of control for turning to ‘the sound nation’. Nation-states conspire with the knowledge-power(juridical discourse) and make many system to control the female subalterns. However, in the activities to restrain them, there are the simultaneous flux to escape from the control. As we can see the accidents in daily newspaper in 1970s, national projects for the female subalterns who were planned to make them to the ‘sound nation’ by powerful discourse and forcing systems are always confronted with resistance. We can notice not only the force in the juridical discourse which try to restrict the particularities of the female subalterns but also their fear and uneasy. Nevertheless the juridical discourse as knowledge-power are seemed to be very stable, they are actually unstable and hold out against the flux for the break and resistance.
