운전면허 행정처분의 기준과 절차의 문제점과 개선방안

초록
도로교통에 부적합한 위반자를 교통현장에서 배제하거나 제한함으로써 교통상의 위험을 예방할 수 있고, 특히 자동차운전이 일상화된 현대생활에서는 운전면허에 대한 취소 또는 정지 처분 등 행정적 제재야말로 교통사고 다발자 또는 상습 교통위반자에 대한 효과적인 대처방안으로 평가되고 있는 반면, 운전자 등 교통관여자 입장에서는 생활의 수단인 운전면허에 대한 행정처분보다는 벌금 등 형사적 제재를 원하고 있다는 점에서 교통안전이라는 공익과 생활수단의 유지라는 사익을 형량하여 합리적인 행정처분기준을 마련하는 것이 중요하다. 행정처분기준의 설정ㆍ공표는 행정청의 자의적인 권한행사를 방지하고 행정의 통일성을 기하며 처분의 상대방에게 예측가능성을 부여하기 위하여 요청된다. 문제는 행정처분기준을 어느 정도로 구체적으로 규정하여야 하는가에 있다. 행정처분기준의 설정ㆍ공표의 취지에 비추어 처분의 공정성과 합리성을 보장하고 당사자 등에게 예측가능성을 보장하는 정도의 것이어야 한다. 따라서 설정된 행정처분기준이 구체적이지 못한 경우에 그 하자는 관련 행정처분의 독립된 취소사유가 된다고 보아야 한다. 도로교통법령의 개정에 따라 운전면허 행정처분 절차 및 기준도 그와 함께 개선되어 왔다고 볼 수 있다. 물론 아직까지도 행정편의적 측면에서 고려된 운전면허 행정처분기준이나 절차가 없다고 할 수는 없지만 운전면허 행정처분의 집행절차 및 사전ㆍ사후적 구제절차가 합리적으로 규정되어 있고 처분의 기준도 어느 정도 합리적이라고 하여도 무리는 없을 것으로 보인다. 다만, 최근의 행정의 추세가 행정목적의 달성보다는 국민의 편의와 이익을 우선시하는 방향으로 전환되면서 운전면허 행정처분의 실효성을 잃어가고 있는 것이 사실이다. 따라서 운전면허 행정처분의 기초자료로 활용되고 있는 운전면허 벌점제도를 현재의 국민의식 및 교통환경에 적합하도록 개선하는 것이 운전면허 행정처분을 통한 교통사고예방 및 운전자의 교통법규 준수의식을 향상시키는데 기여할 것으로 생각된다.
Abstract
Nowadays, the standards for driver's license disposition serve as an important legal means of achieving the effectiveness of administration and the protection of citizen' rights and interests. Constantly changing and developing administration like a living organism requires the contents of laws and regulations governing such administration be changed accordingly. The standards for driver's license disposition supplementing such laws and regulations must reflect the trends of such change thoroughly in such a manner that does not conflict with the upper laws and regulations and serves to promote citizens' rights and interests in harmony with the public purpose of administration by properly adjusting the degree of administrative measures. However, the standards for driver's license disposition set pursuant to current with the regulations have various problems, which lead to many difficulties in administrative practices and the protection of citizens' rights and interests. So, new standards for driver's license disposition need to be established to solve such problems. In this treatise, this study examine in detail the cintents of the existing standards for driver's license disposition and presents the policy measures to establish new standards for driver's license disposition with a view to serving the security of transparency in the exercise of discretionary powers and promoting citizen's rights and interests.
