The Liability of the Carrier of Goods by Sea on 2007 revised Korean Commercial Law

Most articles of the Hague-Visby and Hamburg rules have been adapted in the 1991 revised Korean Commercial Law. The regulatory focus shifted from shipowner to carrier which is more close to the reality. So, the types of the carriage of goods by sea divided into carriage in a general ship, voyage charter and time charter. The 1991 revision is welcomed due to the some of the baffling problems, such as maritime cargo carrier's liability limitation, and the concurrent liabilities between tort and carrier's liability on contract, are solved. In spite of these revisions, however, there are still some inherent problems in Korean Commercial Law. So, in Aug. 3, 2007, Korean government promulgated the Revised Commercial Law. 2007 revised Korean Commercial Law raise up the limitation of maritime cargo carrier's liability in order to solve the problem of discordance between the Hague-Visby rule and Korean Commercial Law. This revision come into force on the three years following the date of its promulgation(Aug. 3, 2010). In this paper, I examine the maritime cargo carrier's liability on 2007 revised Korean Commercial Law and I express my opinions on some legal issues.
