헌법은 정치공동체 최고의 규범이며, 그 전문은 국가의 정치적 영혼이다. 본 연구는 헌법전문(前文)의 정신사적 의미를 검토하기 위해, 특히 4.19를 헌법전문에 도입하는 문제를 둘러싸고 이루어진 정치적 논쟁을 살펴보았다. 이를 통해 헌법전문에 표방된 대한민국의 정체성과 헌법의 정신적 의미를 고찰하고자 하였다. 정치공동체의 정신은 근본적인 역사적 체험에 의해 탄생되며, 그 체험은 하나의 원형이 된다. 근대 정치이념과 관련하여 가장 근본적 체험은 3･1운동과 4･19사건이었다. 1987년 헌법전문에 대한민국이 3･1운동의 ‘법통’과 4･19의 ‘이념’을 계승하고 있음을 표명한 것도 그 때문이다. 4･19 정신의 의미는 민주이념이다. 그러나 그 정치적 의미는 시대와 주체에 따라 부단히 변화되어 왔다. 4･19를 헌법전문에 도입할 것인지, 또 어떤 의미로 이해할 것인지에 대한 논의는 1960년 이래 1987년까지 지속되었다. 그를 통해 이루어진 최종 합의는, 4.19가 한국 민주주의의 원형적 사건이라는 것이다. 그러나 ‘저항권’으로까지 그 의미가 확장되는 것은 유보되었다.
Abstract
The Constitution is the supreme norm and its preamble represents the spirit of the political community. This paper intends to examine the spirit of the Preamble to the Constitution. Specifically, it studies the political debates on the introduction of the historical meaning of the April 19 Uprising of 1960 into the Preamble to the Constitution. This study articulates the political identity and spirit of Republic of Korea. The spirit of the political community is shaped through the fundamental historical experience and provides the very basis for the formation of political community. In the Korean modern history, the most fundamental experiences were the March 1 Independence Movement of 1919 and the April 19 Uprising of 1960. On this account, the Preamble to the 1987 Constitution claims to inherit those political ideals. Democracy is the ideal of the April 19 Uprising. But the political meaning of the April 19 continued to change unceasingly as time and person changed from 1960 to 1987. According to the last compromise in 1987, however, the April 19 Uprising was agreed to be the first shape-giving event of democracy in Korean history. But, its meaning failed to be expanded and admit the right of resistance.
