법학전문대학원 학사관리에 대하여 법령과 인가기준 및 평가기준은 구체적이고 세밀한 기준을 마련하지 않고 기본적인 원칙을 중심으로 대체적인 윤곽만을 설정하고 있다. 이는 학사관리를 개별 학교들이 특성에 맞도록 적절하게 수행해나갈 것을 예상한 것이며, 개별시스템이 큰 틀에서 원칙에 부합된다면 문제되지 않는다는 점을 분명히 한 것이다. 법학전문대학원협의회의 의결을 통해 현재 25개 법학전문대학원 전체에서 공통적으로 실시하고 있는 학사관리제도는 변호사시험과 관련하여 엄정성을 강화하기 위하여 도입된 것으로서 예외없는 모든 과목의 엄격한 상대평가, 공통된 학점분포, 유급제도 등 제도의 도입을 통해 법학전문대학원 학사관리의 표준화를 이루어냈다. 엄정성 강화를 통하여 달성하고자 하는 것은 개인별 능력과 효율의 극대화였다. 그러나 강화된 학사관리제도는 학생들로 하여금 전통적인 과목과 수업방식에 집중하라는 메시지를 전달하고 있으며, 이러한 점은 현실로 나타나서 결국 다양성이나 공정성의 면에서 문제점을 야기하고 있다. 제도의 보완을 통하여 이러한 문제를 해결해나갈 수 있어야 하겠으나 제기된 문제들이 근본적인 구조에서 발생하는 것이라면 단순한 일부 제도의 보완만으로 해결될 수 없다. 제도 전반에 대한 재검토가 필요하다.
Abstract
Rules and Regulations of the Government provide only basic principles for the administration of educational matters. They give each law school the authority of making rules of matters according to its own education goals. It means that the government has no intention to take control over the school if the rules of each school do not violate the basic principles. Current system of administration was made by the Korean Association of Law Schools and was adopted by all law schools. The goal of the new system is to intensify the rules of managing educational matters and contains the rules of relative grading without any exception, unified grading rate and the adoption of class holdover system. The purpose of the system is to make each student's academic capacity higher and maximize the efficiency of law school education. But as many students still continue to concentrate on major law classes such as civil and criminal law, the new system brings about the problem of fairness and diversity. We must make efforts to solve these problems by supplementing the weak points of the current system.
