미국 연방법상 Mail and Wire Fraud에 관한 연구

초록
최근 미국에서는 배임을 처벌하지 않는다거나 우리식의 배임죄 조항(혹은 그 운용)이 글로벌 스탠다드에 맞지 않는다는 취지의 주장이 있는 상황에서 미국에서는 우리식의 배임에 대해 어떻게 대처하는지를 살펴보는 것은 의미 있는 일이라고 생각한다. 미국에서는 우리식의 배임죄 조항이 없는 반면 연방법상의 mail fraud나 wire fraud가 우리식의 배임뿐만 아니라 그 이상을 커버하고 있다. 이에 미국 연방법상의 mail and wire fraud에 대한 자세한 소개를 하고자 본 논문을 기획하였다. 우선 관련 연방법 조항을 소개하고, 연혁적으로 어떻게 변천하여 왔는지 살펴보았다. 원래 우편법에 있던 조항이 어떻게 white collar crime의 대명사로 될 수 있었는지에 관해 자세하게 소개하였다. 특히 판례법을 통해 발전해 온 honest service 이론이 1988년에 미의회에서 18 U.S.C. §1346를 신설함으로 명문화 되는 과정을 상세히 담았다. 또한 mail and wire fraud 관련 판례를 최대한 풍부하게 소개하였다. 원래 부패척결과 상관없이 제정된 조항이 연방검찰의 과감한 의율로 인해 공적․사적 영역의 부패척결에 가장 강력한 무기로 재탄생되는 과정을 실제 판결례를 통해 여실히 보여주고자 하였다. 우선 연방대법원에서 최초로 제동을 건 McNally 판결 이전과 이후로 나누어 honset services fraud 이론이 어떻게 발전해 왔는지 설명하였다. 나아가 McNally 판결에 대한 미 의회의 신속한 대응인 §1346조 신설 이후의 판결도 다양한 각도로 분석하여 소개하였다. 또한 최근에 선고된 Skilling 판결은 제2의 McNally 판결이라고 불릴 뿐만 아니라 유명한 엔론사건 관련 판결로서 커다란 주목을 끌었는데 이에 대한 상세한 소개를 통해 mail and wire fraud에 대한 최신 동향까지 자세하게 다루었다. 법규정 및 연혁적 고찰 그리고 풍부한 판례 소개를 통해 mail and wire fraud를 입체적으로 분석한 후 우리 식의 배임과 비교를 해 보았다. 우선 mail and wire fraud를 우리식의 뇌물, 배임, 배임수증재 등도 커버할 수 있게 만든 honest services 이론이 구체적으로 어떤 것이며 전통적인 fraud와 어떤 면에서 다른지 설명하였다. 그 후 우리식의 배임과는 재산상 손해, 재산상 이익, 인과관계 등 구성요건 측면에서 과연 어떤 차이점을 보이는지 나름대로 분석해 보았다. 결론적으로 미국에서 배임을 처벌하지 않는다거나 우리식의 배임이 글로벌 스탠다드에 안 맞는다는 주장은 모두 설득력이 없음을 논증하였다. 특히 우리식의 배임죄 조항과 그 운용이 미국의 mail and wire fraud 조항에 비해 결코 못하지 않음을 지적하였다. 끝으로 우리 법제와 문화의 지역성(locality)에 천착하여 문제를 깊이 있게 연구하고 최상의 해결책을 강구하는 것이 최선임을 강조하였다.
Abstract
Given the recent claims asserting that the cases of breach of trust in Korea are not prosecuted under the U.S. criminal system and that the statutes of Korea on breach of trust are not consistent with the global standards, it is deemed meaningful to look into how the U.S. legal system redresses such type of cases as defined in Korea. While there are no statues that specifically addresses the breach of trust cases in the U.S., the statutes on mail and wire fraud stipulated in the U.S. Code adequately cover those cases, as defined in the Korean system. Accordingly, this paper aims to discuss the mail and wire fraud aspects in more detail as codified in the U.S. Code. First of all, this paper introduces the related statutes of the U.S. Code on the pertinent issues, and then looks into the historical development of the law. More specifically, this paper describes in detail how the statutes were originally enacted as part of a broad revision of the post code which became the representative statutes on the cases of white collar crimes. In particular, the paper explains the process in which the “honest service theory” that had been developing in the case law became codified in the U.S. Code with the enactment of 18 U.S.C. 1346 in the U.S. legislature in 1988. In addition, this paper intends to introduce as many cases as possible regarding mail and wire fraud. The objective is to clearly show how the statutes that had originally been irrelevant to anti-corruption efforts were reborn to become the most powerful tool of such efforts in both the public and the private sectors according to the determined application thereof by the U.S. Federal Prosecutors’ Office. To begin with, the development process of the honest services theory before and after the McNally case, which was the first ruling of the U.S. Supreme Court, aiming to uphold the prosecution from applying the statutes for such expanded purposes. And then the rulings after the enactment of Article 1346 of the Code, which were swift responses from the US legislature regarding the McNally, which had been analyzed from diverse perspectives. The recent Skilling case, which is known as the second McNally ruling that has drawn wide attention as it was related to the famous Enron scandal, is introduced in detail in the paper with an aim to cover the most recent trends regarding mail and wire fraud. A dimensional and comprehensive analysis of mail and wire fraud was undertaken by looking into relevant laws and regulations as well as historical development and related precedents. This paper compares those mail and wire fraud cases in the U.S. to the cases of breach of trust in Korea. To that end, the paper first introduces in detail about the honest services theory, which enabled the category of mail and wire fraud to cover the cases relevant to Korea’s bribery, breach of trust and kickbacks. The difference between honest services fraud and traditional fraudis explained. In addition, an analysis is made to find the difference between mail and wire fraud in the U.S. and the cases of breach of trust in Korea in terms of their components, such as property damage, profit, and its causal relationship. In conclusion, this paper aims to prove wrong that the claims that breach of trust as defined in Korea is not prosecuted in the U.S. legal system and that the Korean statutes regarding breach of trust are inconsistent with global standards. In particular, it has been pointed out that the breach of trust statutes and their applications under Korean law are as effective as the mail and wire fraud statutes of the U.S. Lastly, this paper emphasizes that the best approach is to carry out in-depth studies and explore optimum solutions by taking into account the unique aspects of the Korean laws and regulations as well as its cultural locality.
