미래인터넷에서 콘텐츠의 보호와 관련한 이슈에 대한 검토

초록
미래인터넷(Future Internet)이 구체적으로 어떤 모습으로 전개될지를 현재로서는 정확하게 그릴 수 없다. 그러나 전문적인 전망에 의하면 스마트(smart)형 인터넷서비스, 유비쿼터스형 인터넷서비스, 그린(green)형 인터넷서비스, 안전(safety)형 인터넷서비스, 실감(realistic)형 인터넷서비스 등으로 미래인터넷의 특징을 요약할 수 있다. 여하튼 미래인터넷은 이미 1960년대에 태어나서 날로 증가하는 트래픽이나 악성봇(Bot) 등 각종의 장애를 더 이상 감당하기 어렵게 된 현행의 인터넷이 가지는 단점을 극복하여 미래인터넷환경에서는 누구든 언제 어디에서나, 어떤서비스인가를 묻지 아니하고 개인의 특성이나 상황에 맞는 최적의 서비스를 끊임없이 제공받을 수 있게 될 전망이다. 미래인터넷은 기존의 인터넷이 가지는 문제에 대한 단순한 보완이나 기존의 인터넷의 진화가 아니라, 새판짜기에 다름없는 개혁이라고 할 수 있다. 그러므로 미래인터넷에서 제기되는 과제로는 전혀 새로운 방식에 관한 기술적 이슈뿐만 아니라, 사회·문화적으로도 다양한 새로운 이슈가 제기된다. 미래인터넷이 던지는 사회적, 법적·제도적 이슈의 하나가 바로 미래인터넷을 통하여 유통, 거래되는 콘텐츠의 보호와 육성에 따른 과제라고 할 수 있다. 물론 현재의 인터넷에서도 디지털콘텐츠의 보호나 육성에 관한 문제가 다각적으로 규율되고 있고, 또한 지속적으로 논의가 전개되고 있다. 역시 미래인터넷에서도그 환경에 맞는 혁신적인 새로운 콘텐츠가 전혀 예견하지 못한 분야에서까지 등장할 전망이고, 또한 새로운 경향의 콘텐츠의 보호나 육성에 관한 새로운 논의와 방향제시가 요구되지 않을 수 없다. 다만 미래인터넷에서의 콘텐츠의 보호와 육성에관한 주된 방향은 콘텐츠의 창조, 보호와 육성, 활용 사이의 호순환(好循環)이라고보아야 한다. 그러므로 미래인터넷환경에서는 콘텐츠를 너무 규제하여서는 안된다고 보며, 규제보다는 활발한 이용의 증진에 초점을 맞추어 다양하고 창의적인 콘텐츠의 창출이 보장되어야 한다. 특히 미래인터넷에서 유통되는 콘텐츠는 지금보다 훨씬 더 글로벌성을 가질 전망이므로, 세계에서 고립되지 아니하고, 오히려 세계적 추세를 선도하는 제도가 필요하다.
Abstract
No one can describe exactly how the future internet will be developed. However, under the experimental prospects, it would be characterized as smart-type, ubiquitous-type, green-type, safety-type and realistic-type internet. Anyhow, the future internet will get over various obstacles such as internet traffic and vicious bot that the current internet system has had since 1960's and will provide the best service anybody can use in anytime, anywhere. The future internet is not just supplementation or development of current internet system but a kind of new reformation. Therefore, some possible issues in the future internet are not only about new technical issues but also about a variety of social and cultural ones. Among other things, a main task is the protecting and promoting of the content which will be distributed and traded through the future internet. Of course, this issue is regulated in many ways and still discussed for improvement under the current internet. A innovative new content will be appeared in the future internet era and it has no choice but to be discussed and suggested new ways to protect and promote it. It should be expected the main direction of protecting and promoting of the contents under the future internet will be a good circulation of creation, protection, promotion and application of the contents. Therefore, under the future internet system, the contents should not be regulated strictly but guaranteed to create various and innovative contents.
