공법교육의 활성화 방안에 관한 연구 ― 헌법교육의 활성화 방안을 중심으로 ―

If the high-quality and low-priced service market is targeted by foreign law firms after the legal market is actively opened, it is clear that the domestic legal market will face a crisis. In such a rapidly-changing educational environment for legal studies, it is especially important to activate various kinds of education for public law with a point of view towards the commercialization of public law. It is necessary to improve legal services based on the in-depth understanding about the overall social structure and public law in Korea. It seems to be extremely important to strengthen professionalism in such fields as intellectual property rights, international arbitration, financial transactions, foreign investment, shipping and air transport, and trade unions. For the legal advice related to such fields as international arbitration, financial transactions and foreign investment, it is important for the Korean government to activate the education for public law. In order to develop the level of international competitiveness in Korea by training legal experts through the law-school system and provide legal consumers with high-quality legal services, the activation of the education for constitutional law is a prior task to be solved. Without specializing and activating the education for constitutional law which regulates every kind of law, it would be impossible to achieve the objective of developing international competitiveness or providing high-quality legal services. For the successful law-school education by activating the education for constitutional law, the following conditions must be considered. Firstly, it is necessary to harmonize the education for the theories of constitutional law and the one for precedents. In order to train competent attorneys who could provide high-quality legal services by responding to various kinds of expectation and request from the nation, it is necessary to provide them with basic legal knowledge. Such knowledge originates from the activation of the education for precedents, which is based on the strong education for constitutional law. The education for the theories of constitutional law and the one for precedents could never be separated from each other. It is necessary to execute the different types of education properly in a harmonious way. Secondly, the education for the analysis of cases can be used to realize an educational program which could develop one's problem-solving capacity and creativity through various cases. The education for the analysis of cases is effective for all the responses towards a rapidly-changing law market and an active law market. Thirdly, it is necessary to expand the education for practical law. It is necessary to actively expand the education for practical law, since it is the kind of legal education which enables students to experience the necessary practical tasks at work as attorneys.
