한-중 FTA와 위생 및 식물위생 조치에 관한 연구

2006년 11월 17일, 김현종 전 외교통상부 통상교섭 본부장은 버시라이 전 중국 상무부 부장과 회담을 개최하여, 2007년 초에 한-중FTA에 대한 산관학 가능성 연구를 수행하기로 약속하였으며, 3년이 넘는 연구를 거쳐 2010년 5월 28일 양국 정상의 임석하에 양국 통상장관이 서울에서 산관학 공동연구 종료관련 양해각서에 서명하였다. 그 후, 양국은 2010년 9월 28일-29일 이틀 동안 북경에서 한-중FTA 정부간 사전협의 제1차 회의를 개최하였다. 양국간 FTA체결 시, 그 협상과정에서 SPS조치 관련 내용도 분명히 중요한 이슈로 부각될 것이다. 왜냐하면, 양국은 그 통상관련 주무부처인 한국 외교통상부와 중국 상무부의 연례보고서를 통해 상대국의 SPS조치 중 존재하는 문제점을 지속적으로 제기해 오고 있기 때문이다. 본 논문에서는 양국이 이미 체결한 FTA들에서 이들 SPS조치에 대해 어떠한 규정을 두고 있는지에 대해 비교, 분석함으로써, 한-중FTA에서의 SPS조치 조항에 대해 예측성적인 설계를 하고자 하였다.
Abstract
On November 17th 2006, China and Korea agreed to launch joint study on China-Korea FTA in January 2007, and 3 years later, the two sides completed the Working Group Meeting on China-Korea FTA Joint Feasibility Study. After that, the two parties held governmental prior meetings on September 2010. In China-Korea FTA, the sanitary and phytosanitary related issues will become important, because, the both nations pointed out many problems about sanitary and phytosanitary measures each other through their National Trade Estimate Report. In this article, the author compared and analyzed those provisions which related with sanitary and phytosanitary measures in the FTAs already signed by two sides, and try to make comment on China-Korea FTA.
