운송법제의 개정동향과 개선과제

Since 2007, the Transportation Act has actively been amended according to development of the transportation industry in Korea. On 3th august 2007, the Korean Commercial Code has amended on the Maritime Law section as the Korean Commercial Code Book Ⅴ. It is the meaningful amendment in terms of the Maritime Law involving rules of transport by sea which was to be modernized. On 29th april 2011, Commercial Code was amended on rules of the air transportation by adding the air transportation section to the Commercial Code Book Ⅷ . Also, on 3th march 2011, Legislative Bill has presented to the National Assembly by the Ministry of Justice of the Republic of Korea. This bill consists of the rules to regulate a multimodal transportation on the Commercial Code Book Ⅱ . However, it is not sufficient to deal with the legal issues relating to transportation by land, sea, air and multimodal. These points have also issued by relating the business and academic world. Meanwhile, in the domestic legislation of the transportation,the significant legal issues are how to provide legislative modal and liability of transport operator, etc. In aspect of the points, this article explains especially the legislative trend and the legal issues relating to act of the sea, air,multimodal transportation and then deals with the liability regime and limitation of liability of the each transport operator in land,sea, air and multimodal transport. Finally, I expect that rules of the transportation by land is amended as soon as possible to be harmonized with the other acts on transportation by sea, air and multimodal.
