川上健三의 國際法的 地位 造作에 關한 硏究 －平和線 宣言 時期 日本政府의 ‘竹島=日本領土’ 論理造作－

終戦後、韓国はポツダム宣言によって独立された。その時、独島においても韓国の国民が占有することになった。これは連合国の措置によって確認された。すなわち独島は歴史的権原に基づいた第二次世界大戦直後の連合軍の措置によって暫定的に韓国領土とした。ところが、日本は独島の領有権を主張した。対日平和条約においてはアメリカと英連邦国との間の意見対立があって独島の領有権が確定されなかった。実際連合国の措置によって韓国の管理が確認された独島は続けて韓国が管理することになった。独島問題は韓国と日本との間の問題になった。韓国政府は対日平和条約後マッかーサーラインがなくなると日本が侵入することを憂慮して平和線を宣言して独島が韓国領土であることを明確にした。この際に日本政府は平和線を認めることができないと異議をつけてきた。韓国政府は独島が韓国領土である領土的権原を送付した。日本政府は韓国の論理を日本的やり方で否定した。その後日本も竹島が日本領土である。論理の開発に着手した。その担当者が川上健三である。彼の論理は韓国領土である領土的根源を無視するか否定する方式で独島が韓国領土であることを否定する。一方、川上の論理は日本側の史料に独島関連のものをすべてが日本領土としての根拠であると歪曲する形で竹島が日本のものであると領土的権原を操作したものである。
Abstract
Korea was liberated from Japan right after the Potsdam Declaration in 1945. The Allied Powers confirmed that Dokdo is historically Korean territory at that time. Nevertheless, Japanese government has claimed that it is Japanese territory. The treaty of Peace with Japan, ‘San Francisco Peace Treaty’ in 1951 did not talk about the status of Dokdo clearly because of U.S.-U.K. disagreement. In fact, Korea has managed Dokdo since the Allied Powers’ declaration. The Korean government declared “Peace Line” in 1952 to protect Korean territory from Japan because of the possibility that the MacArthur line would be abolished by the Treaty of San Francisco. The Japanese government protested ‘the declaration of Peace Line’ strongly and did not recognize it. The Korean government sent ‘the lawful ground for Korea’s right to Dokdo’ to the Japanese government. But the Japanese government denied the appropriate lawful ground. Since then, Japan has tried to create the false ground that Dokdo is Japanese territory. One of the persons who started to devise the false ground is Kawakami Kenzou. He denied the fact that Dokdo is Korean territory, defying the appropriate lawful ground for Korea’s right to Dokdo. Based on his false sources, he distorted the historical fact and the sources of international law, claiming that Dokdo belongs to Japan.
