지역교육청의 기능ㆍ조직 개편안에 따른 법적 쟁점 분석

The Local Education Authority at lower level has been operated as a supervisor rather than a supporter of the elementary and secondary schools. The MEST(Ministry of Education, Science, and Technology) plans to change the organization and role of the local education authority as a supporter of the elementary and secondary school. This study reviewed the legal issues on character, title, and jurisdiction of the Local Education Authority, and recommended the specific amendments of the Local Education Autonomy Act relating with the legal issues to change the role of Local Education Authority as a supporter of the elementary and secondary schools. This study also suggested the jurisdiction of the high schools to be changed under the Local Education Authority at lower level. Professional consultants to help the elementary and secondary school should be hired at the Local Educational Authority to carry out the supporting tasks. The allocation of legal authority on the education among the MEST, superintendent of education, local superintendent of education, and principals of schools are necessary from the middle term perspective. To strengthen its legal position and the character of the Local Education Authority as a supporter of the schools, education autonomy at the lower level should be established which may result to hot political debates.
