터키의 EU 가입에 대한 몇 가지 쟁점들: 서양법제사의 세속주의 헌법과 종교자유라는 관점에서

지난 반세기 동안 유럽연합가입을 위한 터키의 노력은 역경과 수모로 점철되었다. 특별히 터키의 EU 가입에 관한 논의는 유럽연합의 공식적 견해와 지역적 견해 사이에 늘 팽팽한 갈등과 비판이 있어왔다. 그 가운데 우리가 다루고자 하는 “터키의 세속주의 헌법과 종교자유”라는 주제 역시 터키가 EU에 가입하는데 커다란 걸림돌 가운데 하나로 작용한다. 왜냐하면 유럽연합 회원국 대부분의 종교가 로마 가톨릭, 개신교, 동방정교회처럼 대체로 그리스도교적 전통과 문화를 바탕으로 형성된 반면, 터키의 이슬람 종교적 전통과는 역사적·문화적 이질감이 크기 때문이다. 이 때문에 터키정부는 터키만을 향한 ‘배타적 차별’이라고 주장한다. 그러나 동시에 터키에 거주하는 소수민족 역시 그들의 신앙과 종교를 유지하기 위해 엄청난 수난과 역경을 겪고 있다. 따라서 터키 정부는 명목상 세속주의 헌법을 표방할 것이 아니라, 진정한 의미의 세속주의 헌법의 정신을 구현해야 할 것이다. 그러한 선행조건이 이루어졌을 때, 터키의 유럽연합 가입은 한 발짝 더 다가설 수 있으리라고 본다.
Abstract
Debate for Turkey's EU accession has always conflicts and criticism between public opinion of EU and local opinion. Because discussion for Turkey's EU accession have to deal with extraordinarily variable and complex history and interest among the countries directly involved. There are many difficult issues, especially the subject of secularism constitution and religious freedom give rise to serious trouble for Turkey. The reason for this is that the most of European countries consists of Christian, for example, Roman Catholic, Protestants, and Eastern Church. So this has a great cultural and religious difference between the members of EU and Turkey. By these reasons Turkey's government have swallowed an countless insult and adversity. Recently some Turkey's politician insists the exclusive discrimination just for Turkey, so we called "the new cultural Berlin Wall". But, at the same time we have to consider with countless insults and passions of ethnic and religious minority in Turkey. Therefore, Turkey's government does not to claim to the nominal secularism constitution, but to protect real religious freedom for the ethnic minority in Turkey. When such preceding conditions were realized, maybe more possible to access EU members for Turkey.
