초록
전세계적으로 이미 74개 국가가 「국제물품매매계약에 관한 유엔협약」에 가입한 상태이고, 지난 2005년 3월 1일부터 한국에서도 발효되어 시행되고 있다. 특히미국, 중국, 일본을 비롯하여 중요한 거래대상국이 모두 유엔매매협약에 가입한 상태이므로, 그 만큼 국제물품매매계약에 유엔매매법이 차지하는 의미가 크다. 거의모든 국제물품매매계약이 유엔매매법에 의하여 규율될 전망이다. 또한 국제물품매매계약과 국내매매계약에 대한 규율이 서로 상이하여야 할 이유가 원칙적으로 없으므로, 장차 어느 국가이든 유엔매매법과 조화되는 방향에서 국내적 계약규범을규율하게 되고, 필요한 경우에는 고쳐나가게 될 전망이다. 국내에서도 민법개정작업이 진행중이다. 해제제도에 관한 국제적 동향, 특히 유엔매매법을 수용하여 민법상의 해제제도를 정비하여야 한다. 해제요건으로서 지금까지 거론된 채무불이행과중대한 불이행이라는 개념의 선택, 해제를 위하여 별도로 채무자에게 부가기간을수여하여야 하는지의 문제 등에 대하여 깊이 있는 사고와 연구가 필요된다.
Abstract
In the world, 74 countries already participated in UN Agreement on Sales Contract of International Goods, and the law is enforced in Korea from March 1,2005. Especially, as important objective countries such as USA, China, and Japan participated in UN Agreement on Sales Contract of International Goods, so the meaning of UN Agreement on Sales Contract of International Goods gets significant in the contracts of international goods. It is expected that almost of sales contract of international goods will be controlled by CISG. There is no reason for indifference between sales contract of international goods and sales contract of native goods, so every country controls native contract norms at the circumstances of making sales contract of native goods harmonious with that of international goods and will revise the law if necessary. Our country is progressing civil law revision. Our country has to accept international tendencies, especially CISG, and has to arrange the system of cancellation in civil law. As a requirement for cancellation, it is necessary to think of and study deeply the selection of the conception on default and serious nonperformance, and the problem if debtors have to be a given an added period separately for cancellation.
