국제법상의 자위권과 국지도발

초록
어느 나라의 무력사용이 자위권 행사로서 합법성과 정당성을 확보하기 위해서는 유엔 헌장의 규정 및 정신에 합치되도록 하는 것이 가장 바람직하다. 국지도발을 중심으로 무력공격의 개념과 자위권 행사 가능성을 검토하면 다음과 같다. 첫째, 소규모 국경 충돌의 경우, 유엔 헌장상의 자위권을 원용하는 것이 어렵다. 하지만 이 경우에도 관습국제법상의 개념인 부대 자위권의 행사를 원용할수 있을 것이다. 반면 대규모의 국경 충돌의 경우, 당연히 자위권을 원용할 수 있다. 둘째, 무장공비를 침투시켜 양민학살이나 국가기간시설에 대해 테러행위를 자행한 경우, 침투 상황 및 규모, 도발의 효과 등에 따라 달리 판단할 수밖에없다. 그러한 행위가 ‘정규군이 행하는 것과 동등한 정도의 규모와 효과’를 갖추거나 혹은 상당한 수준에 이를 경우에는 무력공격으로 간주하여 자위권을 발동할 수 있다. 그러나 그렇지 않은 경우에는 무력공격으로 규정하기 어렵다. 셋째,우리 영토에 몰래 잠입하여 우리 군함에 공격을 가하는 경우 무력공격 발생 후합리적 시간 내에는 자위권을 발동할 수 있다. 그러나 상당한 시간이 경과한 후에는 자위권 행사가 법적으로 불가능하다고 보아야 하다. 넷째, 북한이 백령도,연평도 등 우리 영토 일부를 점령한 경우 점령 상태를 배제하기 위한 무력사용은얼마든지 가능하다. 이 경우 점령이라는 불법 내지 범죄 행위가 계속되고 있기때문에 이를 배제하기 위한 물리적 사용은 당연히 자위권 행사로써 정당화될수 있다.
Abstract
In order to secure legal justification and political legitimacy in the use of armed force as a right of self-defence, it is desirable for a state to carry out military activities according to Article 51 of the United Nations Charter. In case of local provocations, we may consider the possibility of invoking a right of self-defence discriminately in view of the scale and effect of the use of armed force. In case of a mere or small-scale frontier incident, it is difficult to invoke the Article 51 of the Charter of the United Nations. Nevertheless, even in this case, customary right of self-defence may be invoked, which is a concept recognized for a long time under traditional international law. But in case of a border dispute occurring on a large scale, it is natural to exercise a right of self-defence. On the other hand, in case an enemy warship or submarine infiltrate into our territorial sea and attacks our military vessel, it is possible to invoke a right of self-defence within a rational period of time after the occurrence of such attack. But, after considerable space of time elapsed, it is considered legally impossible.
