한국법원의 인권규정의 적용과 발전방향 : 국제인권조약을 중심으로

The problem of Human Rights is not just a domestic one but also an international one these days. Many countries make their own treaties and adapt their own document to ensure Human Rights and also have to respect their own treaties. International Human Rights Treaties have the same effects as domestic law under the article 6(1) of the Constitution of the Republic of Korea. But still, the application of International Human Rights to domestic court is not fully satisfied. Until now the Korean courts have never or little accepted the self-executing of Human Rights Treaties and applied Human Rights Treaties to their judgments. But still, the application of International Human Rights to domestic court is not fully satisfied. Therefore, it is in urgent necessary that we should not only promote education on Human Rights and International Human Rights to our jurists and nomal people. Therefore to apply International Human Rights Treaties to Korean court, all the countries have to establish a law that makes themselves observe the treaties. In conclusion, to apply International Human Rights Treaties to Korean Court,it is the best to understand the substance of treaties, the meaning of treaties and to make appropriate measures(Law system).
