2010년 미국 학교급식 경비지원 관련법률 제ㆍ개정의 의미 분석

이 연구에서는 2010년에 제ㆍ개정된 미국의 학교급식 경비지원 관련 법률의 주요내용과 쟁점 및 의미를 분석하고, 결론 및 시사점을 도출하였다. 결론은 다음과 같다. 첫째, 미국은 가정의 경제력 등을 기준으로 무상 및 할인급식을 지원하고 있으며, 학교 급식 경비지원의 목적을 분명하게 밝히고 효과를 지속적으로 확인하고 있다. 그에 따라 지원대상을 순차적으로 확대하고 있으며, 2010년 무상급식 지원비율이 학교급식 참여인 원의 55.80%이다. 둘째, 미국은 무상 및 할인급식의 신청 및 지원절차를 개선하여 학부모ㆍ학생의 편의를 제공하고 행정기관의 효율성을 강화하기 위해 노력하였다. 셋째, 미국은 아동 및 청소년의 끼니불안정을 해소하고 과체중 및 비만을 해소하기 위해 노력하고 있 다. 넷째, 미국의 급식경비 지원정책은 농촌경제와 분리하여 생각할 수 없으며, 농무부가 학교에 농산물을 포함한 식품을 무상 및 할인 지원하는 것은 잉여농산물 소비 촉진의 차 원에서 이해할 필요가 있다. 다섯째, 미국은 급식경비 지원학생의 개인정보 및 인권을 보 호하기 위해 행정기관이 취할 수 있는 실질적인 조치를 관련 법령에 규정하였다. 미국의 2010년 학교급식 경비지원 관련법률 제ㆍ개정이 우리나라에 주는 시사점으로는 무상급식의 목적을 명확히 할 것, 중장기적인 재원확보 방안이 마련될 때까지는 끼니불 안정 학생에게 우선 지원할 것, 지원절차를 개선하여 학부모의 편의성과 행정의 효율성 을 높일 것, 학교급식을 통한 학생의 과체중 및 비만 해소와 건강증진에 관심을 가질 것, 농촌 및 지역경제 활성화와 연계한 학교급식 정책을 추진할 것, 학생의 개인정보 및 인 권보호 의무와 위반시의 벌칙규정을 법령으로 규정하는 방안을 검토할 것 등이다.
Abstract
This paper analyses revised bills concerning the school meal programs in the USA. On the basis of the main contents of analysis, we can draw some conclusions considering the adoptation of legislature for free school meal. The findings of this study are briefly summarized as follows: Firstly, the percentage of supporting free school meals in the USA is 55.80% among those who participate in the school meal program in 2010. Free school meals programs have gradually expanded to the scope of recipients for free school meal programs. In consideration of the before-mentioned case in the USA, it is imperative that financial aids for students who suffer from food insecurity take priority of the management of school meal program, and then expand the scope of supporting free school meals. Secondly, the agencies concerned in school meal programs simplify complicated administrative procedures for supporting financial aids of school meals. This helps provide conveniences for students and their parents concerned and strengthen the effectiveness of administrative procedures in the agencies. Given the ongoing process in the USA, this helps decide the course of legislation concerned in the adoption of free school meals for all students in Korea. Thirdly, a variety of measures which U. S. agencies take for protection of students' privacy and personal data are specified in the law concerned. On the contrary to this, there remains the lack of awareness concerning the protection of students' privacy and personal data. Therefore, legislative action for penal provisions could be considered concerning the negligence of Local Education Agency, Schools and teaching staff.
