u-Paperless Korea 추진전략의 하나로 종이문서 없는 환경을 구축하고자 하는 노력이근래에 진행되어 왔고 이러한 노력의 일환으로 전자거래기본법을 개정하기 위한 노력이이루어졌다. 그 결과물이 전자거래 및 전자문서에 관한 기본법(안)이다. 동법의 핵심내용은 전자문서에 관하여 기본법적 효력을 부여하고, 전자문서유통산업을 활성화를 도모하며 전자문서사업자에게 인증제도를 제공하여 사업적 인센티브를 제공하는 것이라고 할수 있다. 그러나 이러한 목적개념외에도 학문적으로는 전자적 의사표시 개념을 도입하고 있다는 점도 중요한 논제라고 할 것이다. 전자적 의사표시의 개념이 개정안 검토과정에서 삭제되기는 하였으나 삭제이유가 민법개정안에 포함하여 논의될 수 있다는 것이므로 개념자체에 관한 논의는 매우 중요한 과제라고 할 수 있다. 동법안의 문제점은 우선 기존 전자문서관련 법률들이 정하고 있는 전자문서의 개념을통일화하고 있지 못하고 전자문서와 전자정보를 동일시하여 기존 법률과 그 개념이 충돌하는 현상을 보이고 있다. 또한 전자적 의사표시에 전자문서의 개념을 포함시킴으로써법이 요구하는 전자적 의사표시개념과 별도의 규정이 필요없는 전자적 방법에 의한 의사표시의 증거방법을 혼동하고 있다. 이외에 전자문서사업자 들은 개별민간사업자임에도 불구하고 개인(소비자)의 보호를위한 법적 안전조치에 너무 미흡한 점을 나타내고 있다. 촉진목적의 법개정이라는 개정목적의 한계는 이해하지만 그로인한 국민의 피해에 보다 적극적인 법적 규율이 필요하다고 생각한다.
Abstract
Korea government notice the lawmaking of e-commerce and electronic documents act. so it contributes to make paperless-korea. In addition to, the bill has a important point of jurisprudential study. it is the concept of electronic intention-declaration(it is called Willenserklerung in german). as the bill was reviewed, the concept of electronic intention-declaration is has been deleted. because the concept would be enacted a provision of civil law. the bill has some points in dispute. main issue is that it is basic act on e-commerce and electronic documents. now, many acts have provisions for electronic document. the bill is just one of those. electronic document article in the bill conflicts with others act. it is because the bill mix electronic document with electronic information or data The second issue is interest mediation between citizen(user) and electronic document center. electronic document center is merely a sevice provider. as the bill aims to promote the growth of electronic document service business. it overlook the protection of citizen information and privacy
