The legal problem of IP policy of SSO(Standards setting organization)

In the past, the standard does not include patents, patent-free standard was common assumption. However, using patents in standardization becomes a key strategy in the field of high technology. SSO(Standards setting organization) such as ISO/IEC, ITU patent policy have RAND and FRAND condition. In the process of standardization, patent ambush activity across all industries increase the cost of the transfer of technology. EU Commission in December 2009 have treated four Rambus patents in the semiconductor design. Post control using competition law enforcement have less effective than prevention control. To deal with this problem, this study suggested the need for guideline fo SSO.
