A Legal Study on the Farmland Security -Focusing on the Mortgage Servicing and Remedies-

Korean Civil law has been applicable to farmland security until the legislation of Farmland Security law 1966. Since 1996 Korean Farmland law has some restrictions on security transaction of farmland in order to protect farmer’s right, and to preserve farmland. Korean Agricultural Cooperatives has lots of claims of farmland security among the financial institutes and 1/4 of their mutual security funds are related with farmland. But there are some problems in auction procedure of farmland, for example, decrease of sale price, sale to non-farmers, auction cost of mortgagee. We need an alternative reasonable solution and efficient risk management system which satisfy cooperatives, as well as farmer members. This paper suggests some kind of the alternative solution, e.g, lease priority to land- lessee (invoking old Korean farmland security law), nation’s right to purchase farmland on the auction (citing Japanese farmland law), lessee's right to priority to buy (invoking droit de préemption of French Code rural, Korean Law of Lease of Housing). Furthermore, we need general approach related to farmland bank in Korean government. This paper can provide us with some idea to the legal development between the mortgage servicing of cooperative as mortgagee and the remedies of cooperative member farmers as mortgagor.
