개혁개방 이후 중국 보험법(보험계약법)의 변화와 특색

The first Chinese insurance law after reformation and Opening was "Insurance Law of the People's Republic of China, 1995"(here in after "the Law 1995). previous insurance legislations before the Law 1995 are "the Regulation on Property Insurance Contract 1983" and "Interim Regulation on Insurance Business Management,1985". The above two regulations had been very important in controlling insurance market in China before the Law, 1995 and each regulation had been almost like representative roll of the two laws which are insurace contract law and insurance business law. But the Law,1995 was unified law of insurance contract law and insurance business law and also has some problem in insurance law system The first amendment of the Law,1995 was concerning to China's entering WTO and some changes are mainly to the insurance business law's parts in 2002. As development of Chinese economy has been growing rapidly, the environment of insurance business in China also much changed and the second amendment was carried out in 2009. the Chinese laws generally belong to Continental Law Family and the Law,1995 is not exception. but Marine Insurance Contract Law which consists of the Marine Code belong to that of Anglo-American Law. The Changes in aspect of 0.legislation in China from" Reformation and Opening" to nowadays might seem to follow the policy of " first draft the retail and then draft the whole sale"(一個成熟 一個制定), like processing to enact regulations at first and then law.
