이 글은 ADR에 관한 법경제학적 연구결과와 라즈의 권위 이론에 터 잡아 환경분쟁조정제도의 발전을 위해 필요한 법정책을 제시하고 있다. 환경문제의 해결을 위해 필요한 환경소송은 사회가 필요한 만큼 제기되지 않는 경향이 있다. 환경분쟁조정제도가 요구되는 것은 이 제도가 환경분쟁의 해결에 드는 비용을 절감해 과소소송의 경향을 극복할 수 있기 때문이다. 따라서 환경분쟁조정제도의 개선책은 환경분쟁조정비용을 최소화하는 것을 목표로 하여야 하며, 환경분쟁조정 결과의 “판결예측력”을 제고하는 것은 그 핵심 수단이 된다. 그런데 이런 결론은 환경분쟁조정제도의 취지를 고려할 때 실망스러운 것이다. 왜냐하면 이는 환경소송이 지닌 한계를 극복하기 위해 탄생한 환경분쟁조정제도의 자기부정을 의미하기 때문이다. 이러한 딜레마상황을 타개할 수 있는 유일한 방안은 환경분쟁조정위원회가 법원으로부터 “이론적권위”를 인정받는 것이다. 이를 위해서 환경분쟁조정위원회는 ① 자신의 판단을 법원이 원래 가지고 있는 근거들에 기초해서 내려야 하고(의존테제), ② 그 판단은 법원이 독자적으로 판단할 때보다 그 근거들에 더욱 부합하여야 한다(통상정당화테제). 환경분쟁은 일반 분쟁과 달리 사실관계의 파악(가령 인과관계의 규명)에 있어서 전문성을 요하고 그 처리(가령 손해의 산정)에 있어서도 경험에 터 잡은 식견을 필요로 하는데, 환경분쟁조정위원회가 이런 측면에서 전문성과 수월성을 인정받는다면 법원으로부터 이론적 권위를 인정받을 수 있을 것이다. 이와 같이 인정된 환경분쟁조정위원회의 이론적 권위가 지속되고 그 결과 이제 그 권위가 환경분쟁에 관한 한 사회 구성원 모두에게 눈의 띄는 지위에 오를 만큼 확립된다면, 환경분쟁조정위원회의 판단은 “사실의 문제”를 넘어 “무엇이 법이어야 하는가?”에 관해서도 법원의 존중을 획득할 수 있을 것이다. 이 글은 이상을 토대로 하여 환경분쟁조정위원회의 이론적 권위를 확립하기 위해 필요한 다양한 법정책을 제시ㆍ평가하고 있다.
Abstract
Based on the result of economic analysis on ADR and Joseph Raz’s theory of authority, this article proposes a few policy proposals to increase people's use of the “environmental dispute resolution” (hereinafter, “EDR”), an ADR system that the “Environmental Dispute Adjustment Act” has provided to cope with complicated environmental disputes. Environmental litigations, although they are necessary to cope with environmental problems, are filed less than are socially needed. The reason why EDR is invented is that EDR can reduce the cost necessary to resolve environmental disputes to such an extent that it can successfully overcome the current trend of “under-litigation” in environmental disputes. Therefore, the policy proposals designed to improve EDR should aim at minimizing the dispute resolution cost of EDR, and their essential means should be institutional and operational reforms to enhance the value of EDR as prediction of the court’s decision. If one takes the raison d’étre of EDR into account, the conclusion above is quite disappointing. Given the purpose of EDR, it would be EDR’s self-negation because EDR was originally invented to cure the flaws and limitations of environmental litigations. The only way to solve this dilemma is to make the courts respect EDR’s decisions, that is, to establish the authority of EDR vis-à-vis the courts. To establish such authority, the “Environmental Disputes Adjustment Committee” (hereinafter, “EDAC”), should ① depend its judgment upon the reasons that courts already have recognized on the issues concerned, (“dependency thesis”) and ② make its judgment comply with the reasons better than the courts themselves so that it can be of service to the courts. (“normal justification thesis”) As compared to other legal disputes, resolution of environmental disputes needs considerable expertise in dealing with question of facts such as causation and damage. If EDAC is successfully accepted as an organization equipped with such expertise, then the courts shall recognize theoretical authority for EDAC. Furthermore, if EDAC can successfully keep its theoretical authority long enough for the general public as well as the courts to recognize EDAC to be in the salient position to decide environmental disputes, EDAC will not only receive respect from the courts about question of facts, but also about question of law such as “what should be the governing law for environmental disputes?” Based upon this framework, this article explores a wide variety of policy options which might help establish the authority of EDAC.
