The human is bone not by himself, but as a member of the Family. This is means next sentences. Man starts not alone in the world. He make a first start as the members of a family, what is called A Baby of Mother. Then most of babies are brought up between family members, and grow into their own man. And they become members of the community. For this reason, we could group 'human' into three classes. One is Human being apart from the other creatures, another is an independent being who distinguish from the others, and the other is a related being who has some connection with his opponent. On the basis of the three type, the social norm is formed and the structure of nation is built. The understandings of human are a difference between the East(Confucianism) and West(Modernism). Therefore this study will do above all to compare two cultures and look for the desirable law that will contribute to human right.
