국내 한계기업의 구조조정을 위한 법과 정책의 변화와 그 대안을 위한 서론적 고찰

Although pursuing their growth and development, many companies can fall into the category of marginal companies by the reason of unexpected circumstances. The company fallen into the category of marginal companies,should restructure including cost management strategies, concentration on core business and reduction of debt ratio. However, many marginal companies still hesitate to restructure their business due to wrong recognition of restructuring and insufficient legal systems and related infrastructure for implementing its business restructuring. Therefore, it is a very important issue to establish a self-regulated market so that marginal companies can positively participate into business restructuring. However, it is needed to introduce a more innovative restructuring system because there is a limit to fundamental changes in the marginal companies. To introduce this innovative system, the role of market participants such as M&A, PEF and LBO leading the global money market are important. However, to utilize these market participants as a substitute of business restructuring for these marginal companies, changes of the policy and establishment of the legal system are needed. Therefore, this study will be focused on the effective methods to draw these changes so as to activate business restructuring and rehabilitate smoothly for the marginal companies.
