교도소 수형자의 규율위반 행동에 대한 분석: 피해 경험과 절차적 공정성의 효과를 중심으로

This study is designed to find out the factors affecting rule-violations and misconduct of Korean prisoners. The premise of the study is that prison order and safety should be sustained in order to achieve the two main goals of corrections:execution of punishment and, at the same time, rehabilitation and treatment. Inmate's misconduct has long been analyzed with the frames of importation and deprivation model; The results are mixed. In some studies the importation model prevails to explain behavior of prisoners, but the deprivation model has more power in explaining prison violence in other studies. Thus, it seems better to find more relevant factors to explain inmates behavior rather than to stick on either/or tests for these two rival hypotheses. Based on this understanding on prison misconduct, this study tries first to test the importation and deprivation models and then to add two new factors in analyzing rule violations: victimization experience and fear of victimization of inmates, on the one hand, and perceptions about procedural justice, on the other hand. Using 986 cases from 20 prisons nationwide, this study analyzed various rule violations and misconduct of Korean prisoners. The findings are: 1) age and self-control as indicators of the importation model affected rule violations of inmates consistently. The effects of these variables remained even after other variables entered into the model. 2) the pain of imprisonment and time-served also affected prisoners' misconducts significantly. 3) the victimization experience of inmates had the biggest power in explaining inmates misconduct. 4) procedural justice represented by distrust with prison staffs failed to show its effects. Implications of these findings are discussed
