헌법 재정조항의 개정방향 : 헌법연구 자문위원회(안)을 중심으로

본 연구는 2008년 8월 국회 내에 설치된 ‘헌법연구 자문위원회’가 정리한 헌법 재정조항 개정제안에 대하여 재정학적 시각에서 의견을 정리하고자 하였다. 첫째, 헌법연구 자문위원회가 재정범위와 재정규모, 재정수지, 재정부채 등 재정총량 준칙(準則)과 관련하여 제안한 사항들은 보다 포괄적이고도 보편적인 재정개념으로 정리될 필요가 있다.둘째, 자문위원회는 세입법률주의를 건의하고 있는데, 세입은 조세, 부담금 외에도 이자, 임대료 등 재산수입을 포함하는 국가수입 전체를 망라하는 개념으로서 이들 모두가 법률에 근거할 필요는 없을 것이다. 셋째, 국회의 회계검사권을 국회로 이관하고 결산에 관한 근거규정을 마련해야 한다는 자문위원회의 의견은 적절하지만, 회계검사원의 직무수행이 행정부로부터 독립되는 것이 중요하지 그 임명권이 반드시 의회에 의해 수행될 필요는 없을 것이다. 넷째, 헌법연구 자문위원회는 예산법률주의를 채택하여 사업집행의 예산규율을 확립하고 의회가 재정통제의 중심에 있어야 함을 확인하고 있는데, 이는 재정민주주의의 확립에 도움이 되지만 국회내 예산 및 결산제도의 합리성이 전제되어야 한다. 특히 예산법률주의는 예산에 대한 대통령의 견해와 국회의 견해가 충돌할 때 이를 적절하게 해소하는 방법을 제시한다는 점에서 주목할 필요가 있다. 여야간의 예산갈등이 첨예할 경우, 현행 제도 하에서는 대통령의 재정사업이 획일적으로 삭감될 우려가 있지만 예산법률주의는 대통령에게 거부권을 인정하여 극단적 충돌을 예방할 수 있다.
Abstract
In modern democracies there has been established as a recognized principle that legislative control over the destination of funds should be exercised through the legislation process for appropriations. That is, the control of government should be rested first of all in the control of the purse and that such control should be exercised by representatives duly elected by and accountable to the people. Legislative control of the purse should be exercised by the 'appropriation acts', which are enacted by the legislative body to carry out the governmental financial plan. To enhance Korean government fiscal accountability, the Korean government budget should include the appropriation bills in a separate part of the budget document. An appropriation in authorizing an expenditure of public money sets certain limitations on such expenditure. These limitations related to the amount, purpose, period of availability, and other legislative requirements. Korean government should adopt the U.S constitutional principle 'No money shall be drawn from the Treasury, but in consequence of appropriations made by law.
