상담을 통한 낙태 결정방식의 헌법적 검토

2010년 프로라이프(Pro-Life) 의사회가 법에 위반되는 낙태를 하는 산부인과 의사를 고발한 이후 잠시 주춤하던 낙태가 다시 시작되고 있지만 낙태기소나 처벌건수가 유의미하게 증가하였다는 통계는 확인되지 않는다. 낙태를 헌법적 상황에서 볼 때 태아의 생명권, 산모의 프라이버시 및 자신의 삶에 대한 자기결정권, 가족과 혼인에 있어 부부의 구성원 결정권, 그리고 구체적 위험에 처한 산모의 사회적 기본권이 관련된다. 기존의 낙태에 대한 형벌을 통한 규제는 그 실효성을 상실하여 더 이상 태아의 생명보호와 산모의 보호에 적절한 수단이 되지 못한다. 이런 상황에서 입법자는 상담을 통한 임신지속 의지를 강화를 목표로 상담방식을 도입할 필요가 있다. 그런데 상담방식은 현재의 적응방식과는 일정한 딜레마 상태에 놓이게 된다. 적응사유에 해당하지 않을 수 있다는 위험부담을 산모에게 이전시키면서 상담절차를 강요하는 것을 산모에게 커다란 부담으로 작용하기 때문에 상담방식은 순수한 기한방식과 결합하여서만이 그 효과를 발휘할 수 있다. 문제는 기한방식을 통한 형벌의 포기가 입법자의 생명 보호의무의 관점에서 가능한가이다. 낙태에서 산모가 가지는 가해자와 피해자로서의 이중성과 태아의 독립성의 결여 등을 근거로 일정한 기한(12주) 내에 전문 상담사와의 상담절차를 거치고 의사에 의해 실행된 낙태는 낙태죄의 구성요건에 해당하지 않는다. 결국 기한방식의 성패는 얼마나 충실하게 상담과정을 형성하느냐에 달려 있다. 상담은 기본적으로 생명에 대한 책임을 호소함으로써 임신 지속의지를 강화할 수 있는 것을 목표로 해야 하지만 개방적인 결과 하에서 산모의 자율적인 변화를 기대할 수 있어야 한다. 또한 상담방식은 필수적으로 성교육의 강화를 동반해야 한다. 입법자는 이제까지의 생명의 절대성만을 강조하면서 거의 효과 없는 형벌만을 유지하는 방안 대신 낙태 상담방식을 통해 낙태에서 소외된 산모의 관점을 부각시키면서 의미 있는 상담을 통해 낙태를 방지하는 방안을 채택할 필요가 있다.
Abstract
After the Pro-life Association have demanded the illegally aborting obstetrician prosecuted in 2010, the report that abortion rate has fallen since then is not verified yet. Abortion problems have relations with fetus's right to life, woman's privacy and right to self-determination on her life, and woman's right to protection when she is in a jeopardy. It is not any more good way to deal abortion doer with provisions of the criminal code. Because the criminal weapon is not any more useful way to deter the abortion. In this situation, legislator need to introduce the Consultation Model; through this Model legislators can make the pregnant woman have the will to sustain her pregnancy. Buy the way, the Consultation Model falls into a dilemma when it combine with Condition Model. Consultation Model is not harmonious with Condition Model. According to the Condition Model, pregnant woman runs a risk to fall in the dilemma that after her voluntary participation in the consultation there will be no exemption from punishment. Therefore, Consultation Model should be combined with genuine Term Model. Success of Term Model relies on whether Consultation Model is filled with sincere effort to understand each other. The goal of the consultation is basically to make the pregnant woman have responsibility for the fetus and have the will to give birth to him. Also Consultation Model should accompany the sex-education program in school.
