대기업과 중소기업의 영업비밀 탈취 방지 방안

This Study focuses on cooperation between SMEs(small and medium sized enterprises) and large corporations. In particular, IT and SW business, big firm take over technic of SMEs. Thus Government has established fair trade policy between SMEs and large corporations. In respect of trade secret, there are various cases unfair to small businesses in the areas of research and development. In this paper, I suggest solution to deal with trade secrets relating to the takeover of technology between SMEs and large corporations. The key element will be kept duty of secret between both parties regardless of NDA(Non Disclosure Agreement). Supreme Court case already stated implied duty of confidentiality in Trade Secret. Anti-takeover measures are required by amending the trade secret act.
