民事訴訟法上 訴訟救助에 관한 小考

초록
경제적인 약자가 소송비용의 부담으로 인해 소송을 통한 분쟁해결을 시도함에 있어 어려움을 겪는 현실을 개선하기 위해 일정한 요건이 갖추어진 경우 당사자로 하여금 소송비용의 납부를 유예 내지 면제해 주어 우선 비용을 들이지 않고 소송을 할 수 있도록 하는 소송구조제도는 21세기 복지국가 사상에 부합하는 면을 가지고 있어 세계 각국에서 유사한 입법례를 비교적 쉽게 찾아볼 수 있다. 우리 역시 1960년 민사소송법 제정 당시부터 소송구조제도를 도입하여 운영해 오고 있으며, 그 활성화에 관한 논의 역시 비교적 활발하게 이루어져 왔다. 또한 이러한 논의를 토대로 민사소송법상 소송구조제도에 여러 가지 변화가 시도되어 왔다. 본고는 먼저 소송구조 활성화를 위한 제도적인 여러 가지 변화가 실제로 소송구조의 활성화에 어느 정도 영향을 미쳤는지를 사법연감을 근거로 정리해 봄으로써 그 의미를 되새기고 이를 통해 향후의 소송구조 활성화를 위한 밑거름을 제공하고자 하였다. 위의 정리를 토대로 현재 소송구조의 활성화에 대해 평가해 보는 한편 향후 소송구조의 활성화에 관한 논의를 함에 있어 생각해 보아야 할 필요가 있는 소송비용의 면제와 소송구조를 바라보는 관점에 따른 예산문제 등의 몇 가지 쟁점에 관해 간략히 살펴보았다.
Abstract
Litigation aid is a financial support system for those who can not afford to pay for legal costs and the system is suitable for a welfare state. So, there are many similar systems in lots of countries. In Korea, litigation aid system was introduced into the civil procedure in 1960. And there was much discussion about the invigoration of the system and there was an attempt to do change on the basis of the result of discussion. This article reviews how the change for the invigoration of the litigation aid system in the law affected the practice on the basis of the jurisdiction yearbooks and estimates the present condition of the invigoration of the system. This helps try something new for the invigoration of the system. Additionally, this article reviews several issues which are the exemption of the legal costs and the budget problem for the invigoration of the litigation aid system.
