선진국 진입 전제로서의 신뢰와 원칙 - 법치주의의 현실과 제언 -

This Study has focused what the preconditon for an advanced country is. The Answer could be found in the Keeping of Trust and principle. There is no methods to find it's way without calling rule of law in a country of constitutional law like Korean society. The country, which governed with the rule of law, are moving itself with foreseeablity, clarity-principle, transparency, the protection of rights and property, the system of legal protection. This kind of factors should be essential forward to an advanced country. But the Reality of rule of law in Korea is crucial in one word. Why is the reason. Our country has been rooted deeply by traditionally agricultral socitey rooted by the idea of confucianism. The social and historical experience affect our society and country. namely our not obeying the rule of law means to devote ourselves for our country. The distrust of law, the defect of the law itself, the so called network- and groupsociety have contribute to the reality of our rule of law. For the restoring of rule of law it is needed getting over the defect of law itself, through the education or fair performing of law raising up the standard of the will of observing the law or restoring trust from the public.
