WTO 통일 원산지 규정에 관한 고찰

초록
통일 원산지 협상은 당초 3년을 시한으로 하여 WTO 출범직후부터 논의를 시작하였으나, 아직까지도 타결에 이르지 못하고 있다. 본고는 통일 원산지 규정 협상에 있어서의 주요 쟁점 및 각국의 입장에 대하여 고찰하고 협상 교착의 원인에 대하여 분석하였다. 통일 원산지 규정은 크게 총칙(General Rules)과 2개의 부록(Appendix)으로 구성되어 있다. 먼저 총칙에서는 HS시스템(Harmonized System), 원산지 판정(Determination of Origin), 중립요소(Neutral Elements), 포장재료와 용기(Packing and Packaging Materials and Containers), 부속품ㆍ예비부품 및 공구(Accessories and Spare Parts and Tools), 최소공정(Minimal Operations and Processes) 등의내용이 규정되며, 부록 1(Appendix 1)에서는 완전생산물품(Wholly Obtained Goods), 부록 2(Appendix 2)에서는 품목별 원산지 기준(Product Specific Rules of Origin)에 대하여 규정하고 있다. 아직까지 기계류 등 품목별로 각국의 입장이 대립되어 원산지 기준에 합의하지못한 품목이 남아 있으며, 통일 원산지 규정의 적용범위에 대하여도 견해가 나뉘고있다. 통일 원산지 규정 협상은 많은 품목수, 복잡한 공정, 그리고 다자협상이라는구조적 한계 속에서 단기간에 타결되기는 쉽지 않아 보인다.
Abstract
The Harmonized Rules of Origin has been discussed since the establishment of WTO. This paper reviews outstanding issues and each country's position on the issues and analyzes a current deadlock negotiation. The negotiating text of Harmonized Rules of Origin is composed of two parts:General Rules and Appendices. General Rules include harmonized system, determination of origin, neutral elements, packing and packaging materials and containers, accessories and spare parts and tools, minimal operations and processes. Appendix 1 deals with wholly obtained goods. Appendix 2 covers product specific rules of origin. With regard to product specific rules of origin, countries concerned fail to reach an agreement on many articles including Machinery products. Although the negotiation is still going on, it is difficult to expect the completion of the negotiation in the near future due to the differences of each country's position.
