재개발․노사분규현장에서 불법 용역경비의 폭력행위 실태와 개선방안

초록
현재 노사분규 현장, 재개발 및 각종 개발사업 현장, 노점상 철거 등에서 자행되고 있는 반법치주의 현상은 경비업의 범위와 내용이 불명확하게 규정되고, 실효성 없는 처벌 규정을 두고 있는 경비업법에도 원인이 있지만 경비업법을 위반해도 처벌하지 않는 경찰행정의 방임, 행정행정관습 등에도 원인이 있다. 따라서 경비용역의 폭력사태를 근절하고 예방하기 위해서는 보다 종합적으로 경비용역과관련된 법제도와 행정절차를 개선하여야 한다. 경찰행정 차원에서는 관할경찰서장은 경비원의 명부와 배치 및 이에 대한 신고를 철저히 감독하여 경비원 자격이 없는 자에 대해서는 배치폐지를 명하고, 경비원의 예절, 인권 교육 이행에 대한 감독을 철저히 하며, 경비업체의 과도한 폭력이 발생하는 분쟁현장에 적극적으로 개입하여야 한다. 법제도상으로는 경비업법의벌칙규정과 경비원교육, 복장 휴대 장비 등과 관련한 규정을 보다 강화하여야 한다. 경비업법에서 허용한 장비 이외에 쇠파이프, 소화기 등 불법무기 내지 장비를사용하는 경우를 처벌하고, 경비원임을 식별할 수 있는 복장을 착용하고 신분증명서 등을 부착하도록 하는 등의 법 개정이 절실하다. 이같은 입법의 정비와 경찰행정의 적극적 개입이 복합적으로 이루어질 때만이 경비용역으로 인한 폭력사태가근절될 수 있을 것이며, 또한 헌법상의 인간의 존엄성과 신체의 자유, 주거의 자유가 보장되고 실질적 법치주의가 실현될 수 있을 것이다.
Abstract
These day, violence or illegal behavior by private security guards has increased in redevelopment or labor dispute fields. Although the Private Security Act and related laws are enacted and prohibit illegal behavior, violence cases by private security guards are not eradicated. The forced eviction for the urban redevelopment projects should be executed by the balance of public interest and private interest because it might cause the result of human rights violation. In addition to, the basic rights of workers must be assured by the Constitution and private security guards' activity in labor dispute fields should be executed under the Private Security Act. This study, therefore, aims to remind those problems which are related with violence and illegal behavior by private security guards in social conflict fields. In order to this purpose, I intended to review several cases and the involved laws and note some problems. In addition to, I tried to suggest some improvements for protect housing rights and worker's rights.
