역대 대통령시대의 부동산법의 특징

Characteristics of Real Estate Law of Each Presidential Era

1. CONTENTS (1) RESEARCH OBJECTS Recently, Presidential pledges concerning national land management have become a key concern. In particular, Presidential pledges made by Presidents Roh Moo-Hyun and Lee Myung - Pak in relation to national land management became a major social issue. Even to this day, President Roh Moo - Hyun’s pledges concerning relocation of national capitol and balanced development of regional areas and aftermath side-effects arising from execution thereof are having material impacts both socially and economically. Similarly, President Lee Myung - Pak’s pledges concerning ‘4 Main Rivers’ and ‘Half-price Apartment’ projects and execution there of have brought important changes involving national land. In light of the foregoing, it seems necessary to revisit and re-examine Presidential pledges concerning national land management. The key focus should be whether any of the pledges are inappropriate and whether they are being executed regardless. If these situations are found to occur, possible ways to correct and improve them must be sought. (2) RESEARCH METHOD Presidential pledges regarding national land management and related execution activities can be examined mostly through changes of related laws. Pledges often materialize through enactment or amendment of laws as well as through application of existing laws. Therefore, it is necessary to examine how relevant laws were changed or applied during each President’s era. (3) RESEARCH RESULTS The characteristics of national land management during each Presidential era can be identified by examining how real estate laws were changed or applied during each era. Some characteristics can be identified through examining enactments or changes of laws and some through applications of laws. Many of the major development projects were based on application of existing laws. 2. RESULTS This study shows that real estate laws of each Presidential era to date had different characteristics. Presidents to this date have been: Lee Seung Man,Yun Bo - Sun and then Park Jeung - Hee who held a long-term office, followed by Chai Kyoo - Ha, Chon Du - Hwan, Roh Tae - Woo, Kim Young - Sam, Kim Dae - Jung, Roh Moo - Hyun and Lee Myung - Pak all of whom held single term offices. Of these, development pledges made by Presidents Roh Moo - Hyun and Lee Myung - Pak stand out in particular. Both of these Presidents attempted to execute on their pledges despite oppositions. Such actions resulted in imprudent development of national land. In the future, an appropriate framework or system to promote controlled execution of Presidential pledges must be implemented.
