개성공업지구의 조세구제제도 개선방안 ―사전구제제도의 도입을 중심으로―

과세처분에 위법․부당한 처분이 있거나 있을 것으로 예정된 경우에 위법성 또는 부당성을 제거하는 제도인 조세구제제도로서 북측에는 신소제도가 있다. 개성공업지구의 현행 신소제도는 「개성공업지구 세금규정」 및 「개성공업지구 세금규정 시행세칙」에 규정되어 있다. 비록 신소의 심급 구조가 개성공업지구세무소와 중앙공업지도기관이라는 2단계의 행정심급으로 구성되어 있지만 그 내용은 최소한의 규정으로 이루어져 있다. 또한 관련 인력의 훈련 미비, 관련 법제도의 미비 그리고 장기간의 조세공백이라는 상황이 지속되고 있는 상황이어서, 개성공업지구에서 신소제도를 정상적으로 운영하기에는 어려움이 많다고 판단된다. 이에 따라 남측 투자자인 납세자들의 세법상의 권리도 보호받기에 어려움이 따를 것이다. 이에 본 논문에서는 우리 투자기업을 보호하고 나아가서는 납세자의 권리를 보호한다는 차원에서 개성공업지구에 과세전적부심사제도의 도입을 모색해 보았다. 동 제도를 통해서 납세자는 경제적 비용 및 시간적 비용을 절감할 수 있을 것이고, 나아가서는 납세자의 권리를 보호받을 수 있을 것이다. 과세당국은 과세전적부심사를 심사하는 과정에서 자기조정기능을 할 수 있어서 더 나은 조세제도를 구축하고 더 나은 납세서비스를 제공할 수 있는 출발점이 될 것이라고 판단된다.
Abstract
In North Korea, they have a Reexamination Appeal System as a tax relief system. The system is a two-tier administrative system in which tax appeal is first reviewed by the Kaisong Industrial Complex Tax Office and then by the Central Industrial Control Agency. Though they have the RAS, it is operated by minimal numbers of regulation. They also lack trained staff, related laws and regulations, and effective tax administration. That makes it difficult for the RAS to be effective. As a result, South Korean investors may not be protected enough in their tax disputes with North Korean Tax Administration. In this context, this article proposes to set up a Pre-Assessment Review System in Kaisong Industrial Complex to protect South Korean investors and taxpayers' rights. By this system taxpayers can save economic costs and time. And taxpayers' rights can also be expected to be protected. For the Tax Administration, by this Pre-Assessment Review System, they can make the tax system work better and provide improved tax services.
