일본의 소년심판절차에 있어서 소년조사제도에 관한 고찰

최근 개정을 거듭한 일본의 소년법은 전건송치주의를 채택함으로써 소년사건에 대하여 검사선의주의를 채택하고 있는 우리나라와는 달리 소년과 관련된 모든 사건을 가정법원에서 심리하도록 제도화하고 있다(법원선의주의). 이는 소년의 건전한 육성이라는 현행 소년법의 이념을 구현하기 위하여 가정법원조사관을 비롯한 의무실기관 등 과학적 조사기구를 구축한 가정법원에 모든 소년비행에 관한 선별기능을 부여한 취지라고 평가되고 있다. 따라서 일본 소년사건의 심판절차는 비행소년에 대한 자료를 수집하는 과정으로서의 조사절차와 수집된 자료를 기초로 종국판단을 내리는 공판절차로 구성되어 있으며 조사전치주의를 채택함으로써 공판절차에 앞서 반드시 조사절차를 거치도록 하고 있다. 특히 일본의 조사절차상 소년조사제도는 소년사건의 형사사건과 보호사건을 구분하기에 앞서 가정법원에서 소년의 요보호성에 대한 모든 조사를 담당하도록 하고 있는데, 요보호성 조사는 조사주체인 가정법원의 조사관과 소년감별소가 조사하는 이원적 구조를 취하고 있다. 결국 요보호성 조사는 대체로 가정법원의 조사관에 의해 이루어지는 사회조사 및 시험관찰과 소년감별소에서 이루어지는 자질감별 등으로 구분할 수 있는데, 이 세 가지 조사를 종합한 결과를 처분의견과 함께 가정법원의 조사관이 가정법원에 제출하는 것으로 이루어진다. 본 논문에서는 일본에서 비행사실이 발견된 비행소년에 대한 소년심판절차를 소년조사제도를 중심으로 각 절차단계별로 구체적으로 고찰․소개함으로써 우리나라 소년심판절차상 소년조사제도에의 시사점을 도출하고자 한다.
Abstract
In November 23 2007, Korea revised the Juvenile Law to cooperate with the juvenile justice changes and challenges in policy in which criminal justice and struggles in which academic world and business circles. In above Law, there were Probation in Police, Court-appointed lawyer, Victim-Offender Conciliation, Survey in Prosecution and so on. But, on the contrary to Korea's systems in juvenile justice, all the cases committed by juvenile in Japan should consider first in Juvenile Court. And this estimated proper and appropriate in Justice of juvenile law. As shown above, Japan's juvenile justices subdivide the Juvenile Survey Systems with a view to study and know what the juvenile is, why he is here, what he is going to be when he grows up before judgement by Court. Juvenile Survey Systems in Japan Juvenile Justice are consisted of 4 Systems. First, Juvenile Survey Systems in Police Investigation Process are one of them. In this process, investigator, specially Police, surveys the juvenile and take the proper measures on the rules in juvenile justice. Second, there is Juvenile Survey Systems in Prosecution Process. Third is Juvenile Survey Systems in Court Process. In this chapter, we studied the Law and Order of the Juvenile Survey in Court Process, and the Systems's authorities thoroughly. In this Survey, also, the process and method are considered and what's the important are surveyed. Fourth, Juvenile Survey Systems in Correction Process are also treated in this articles. The Introduction and Classification Standard in Correction Process are studied in with wide and deep views. The Grounds of the Juvenile Survey Systems in Corrections Process and the authorities, process and contents are also treated. In Korean Juvenile Justice Systems, there can be considered Juvenile Survey Systems shown above, specially, 4 Processes by steps in which juvenile justice process take. Similar to Japan's systems, Korea's systems should be considered thoroughly 'Juvenile Exclusive Prosecutor' and 'Juvenile Surveyor', who must have a specialized knowledge and experiences and support the Juvenile Exclusive Prosecutor, and can have an important role in connecting the Juvenile Surveyor in Court and other Surveyor in organization.
