낙태규제에 있어서 형법의 효용성

초록
낙태에 대한 보수적인 입장이든, 자유주의 입장이든 낙태억제를 지향하는 점은 같다는 전제하에서 낙태규제를 위해 형법이 어떤 기능을 하는 것이 적절한지, 그 효용성을 증대시킬 방법이 무엇인지를 모색하였다. 낙태를 어느 범위에서 금지하고 허용할 것인가는 우선 입법에 직접적으로 관련이 되며, 찬반의 논쟁을 통해 허용과 금지의 한계가 정해진다. 낙태규제법은 매우 엄격한 정도에서부터 매우 완화된 정도에 이르기까지 폭넓은 스펙트럼 중 어느 한 점에 위치하게 될 것인데, 어떠한 형태의 낙태규제법이든 그것이 낙태를 억제하는 데 효율적인가는 엄격성과는 별개의 문제가 된다. 실제로 행해지는 수십만 건의 낙태를 떠올리면 일견 형법이 무용한 것으로 평가될 수 있지만, 형법이 실질적으로 아무런 기능을 하지 않는다고 할 수 없다. 형법은 다른 요인들과 더불어 낙태의 결정에 공동으로 영향을 미친다. 형법 이외에도 임부의 도덕적 태도, 임부를 둘러싼 주변사람들의 역할 등 낙태억제에 주된 영향을 미칠 수 있다. 낙태의 경우 형법의 강제가 주된 억제요인이 될 수 없기 때문에 강압적으로 행동을 결정하게 하기보다, 자신의 행동에 책임을 지도록 하는 도덕적 신뢰를 부여할 필요가 있다. 낙태는 금지라는 식의 억압적 성격을 강화할 것이 아니라, 생명보호를 위한 양심에의 호소를 강화하고 임부를 심리적․사회적으로 지원하는 네트워크를 확대한다면 더 큰 낙태억제의 효과가 기대될 수 있을 것이다. 그리고 적응사유의 유무를 제3자가 판단하는 적응방식보다 임부가 자율적인 결정을 내리도록 조언해주는데 초점을 맞추는 기한방식이 사회적 소통의 기회를 더 부여하며 낙태규제방식으로 효용성이 더 클 것으로 보인다.
Abstract
The matter of effectiveness of criminal law on the regulation for abortion, there are great gaps between positive and negative in opinion, but it is hard to analysis because it is based on anti-abortion opinion and opinion that abortion should be selected in personal values. However, based on common opinion that abortion is not right between conservative side and liberalistic side for abortion, we will need to find whether function of criminal laws are waived for regulation of abortion or we can find out appropriate function and the method for increasing its effectiveness For that, there is a side that the function of criminal laws is waived and the proper prevention effect can’t be expected with only criminal laws. In my opinion, however, the announcement that skeptics of criminal law are right shouldn’t be declared and the functions of criminal law may perform because counseling system is a part of system of regulation in criminal law although the decisive role in the decision of pregnancy continuation is not criminal prohibition but counseling system. Thus, we should find out appropriate function of criminal laws and increase its effectiveness with efficiently using confirmation process of adaptation reason and counseling system as a procedural precondition for regulation of abortions.
