초록
오늘날 사회국가는 국민의 공공복리와 국가의 국가경쟁력 향상을 위하여 토지 등을 포함한 재산권의 침해 즉, 공용수용이 빈번히 발생하고 있다. 공용수용은 국가권력에 의한 전형적인 재산권침해로 반드시 정당한 보상을 수반하여야 한다. 그러나 정당한 보상과 관련하여 법률적 규정에도 불구하고 보상의 기준과 범위, 내용, 등에 대한 학문적 논쟁이 계속되고 있다. 그리고 손실보상이 생존권적 문제와 관련하여 아주 중요한 문제로 부각되고 있으며, 사업시행자와 재산권소유자 사이에 정당한 보상과 관련하여 심각한 갈등과 분쟁이 끊이지 않고 있다. 이러한 학문적 논쟁은 각국의 정치 ․ 경제 ․ 사회의 특성에 따라 다를 수 있지만 보상의 내용에 따라 정당한 보상의 기준을 정립하는 것은 매우 중요한 일이다. 그리고 사업시행자와 재산권소유자 갈등과 분쟁의 해결방법은 손실보상의 내용에 따른 기준을 명확히 제시하고, 보상의 범위를 확대 하는 방향으로 손실보상법제를 개선하는 것이다. 따라서 본 연구는 한국과 미국의 손실보상법제의 보상의 내용과 기준을 중심으로 비교 ․ 검토하고 입법적 개선방향을 제시하고자 하였다.
Abstract
Today, taking was came frequently for the public welfare and competitive power in social nations. these taking must was attended by just compensation. by the way, The learned disputing continue of legal theory. and do not stop a confliction between a enterprise and a landowners about just compensation, so that raising to serious social problems. so that raising to serious social problems, as a known fact. it has need of repair to a base law as for taking and compensation to solve such a social problems. And the method of solution a confliction between a enterprise and a landowners is need to suggest of compensation standard correctly, aim to expand comparisons. According to this study make a comparisons between loss compensation laws of korea and loss Compensation laws of America In result, as draw to problems and present to improvement, it was that easy to work public utilities and achieve just compensation. these kinds of matter that the purpose of this study.
