탈북 브로커 계약의 효력에 대한 고찰

초록
현재 국내 입국한 북한이탈주민은 2만 명이 넘어선 상황이다. 국내 입국 북한이탈주민들의 수는 2000년대 초부터 급증하기 시작했으며, 이들은 주로 중국에서 거주하다가 탈북 브로커와 계약을 체결하고 이들을 통해 남한으로 입국을 하게 된다. 중국에서 체류하는 북한이탈주민들은 신분이 발각되는 경우 강제송환의 위험이 있는 등 불안한 상황에서 탈북 브로커 계약을 체결하기 때문에 국내 입국한 후 탈북 브로커 비용의 지급과 관련 분쟁이 발생하는 경우가 발생하기도 한다. 한편 이렇게 북한이탈주민을 남한으로 입국시키는 역할을 하는 탈북 브로커는 북한이탈주민들의 인권을 보호하는 긍정적측면도 있으나 한편으로는 불안정한 북한이탈주민들의 상황을 이용하여 폭리를 취하는 부정적 측면도있다. 이러한 점 때문에 탈북 브로커 계약을 바라보는 상반된 시각이 있을 수 있다. 그러나 보다 사안의 공평한 해결을 위해서는 탈북 브로커 계약에 대한 관념적, 추상적, 획일적 접근에서 벗어나서, 계약의 유효성 판단의 기본 법리에 입각하여 살펴볼 필요가 있다. 구체적으로 탈북 브로커 계약의 효력을판단함에 있어서 준거법, 법적 성질, 반사회질서 해당 여부, 불공정한 법률행위 해당 여부, 강박에 기한법률행위 해당 여부 등이 문제되며, 구체적인 사안에서 탈북 브로커 계약의 체결 경위, 북한이탈주민의해외 체류 기간, 소득 유무와 정도, 탈북 경로 및 방법, 탈북 브로커의 실제 노력 여부 및 정도, 해당경로를 통해 입국했을 때 통상의 비용과 탈북 브로커 계약상 탈북 브로커 비용의 차이 등을 정확히 파악하고 개별 법률 요건에 해당여부를 검토하여 탈북 브로커 계약의 효력을 판단해야 할 것이다.
Abstract
The number of North Korean defectors is over 20,000 in 2011. The number started increasing from early in 2000. They usually stay in China and make a contract with brokers to go to the South Korea. However, after entering the South Korea, they often file a lawsuit against each other because at the time of making a contract, the North Korean defectors are in very dangerous and unstable situation. Therefore the validity of the contract signed between North Korean defector and broker in the processing of escaping to the South Korea comes into question. It should be discussed that the contract applies to a juristic act contrary to social order or an unfair juristic act or a declaration of intention by duress. To figure out this problem, abstract and idealogical approach is not proper. On the other hand, it is important to check all the fact relevance, for example the concrete situation of the contract and the way of escaping to the South Korea etc.
