미국법상 변호사-의뢰인 특권, 소송준비자료의 개시면책에 관한 연구

초록
증거개시제도(discovery)가 인정되어 대부분의 증거가 공개되어야 하는 미국법에서는, 변호사와 의뢰인 사이의 의사소통이나 변호사가 변론을 위하여 준비한 자료를 증거개시제도의 대상에서 배제하여 이를 상대방에게 증거로 공개하지 않도록 하기 위해서 변호사-의뢰인 특권(attorney-client privilege)과 소송준비자료의 개시면책(work-product immunity)을 인정하고 있다. 미국법은 이러한 변호사-의뢰인 특권과 소송준비자료의 개시면책에 관하여 종래에 상세한 논의가 이루어졌으며, 충분한 해석론이 제시되고 있다. 그리고 변호사-의뢰인 특권과 소송준비자료의 개시면책에 대한 충분한 해석론을 통하여 의뢰인이 변호인으로부터 충분한 조력을 받을 수 있는 근거가 마련된 것으로 보인다. 우리 법도 증거개시제도를 도입한 것과 같다는 평가를 받고 있는바, 이에 맞추어변호사와 의뢰인 사이의 의사소통을 보호할 수 있는 법적 장치가 필요하다. 우리 법에도 변호사-의뢰인 특권, 소송준비자료의 개시면책과 유사한 효과를 낼 수 있는 규정들은 존재한다. 하지만 이러한 규정들이 충분히 입법되어 있다고 보기도 어렵고, 이러한 규정들에 관한 적절한 해석론도 제시되지 않고 있다. 최근 하급심 판례에서는 미국법의 변호사-의뢰인 특권을 원용하여 압수된 변호사가 작성한 의견서의 증거능력을 부정하기도 하였는바, 미국법의 논의를 적절히 반영하여 우리 법의 규정을 해석함으로써 현행법의 흠결을 보완해야 할 것이다.
Abstract
During the process of discovery, US law provides attorney-client privilege and work-product immunity in order to protect the communication between attorney-client, and work product from discovery. In the US, Attorney-client privilege and work-product immunity has been discussed in detail and many theories have been proposed, making the right to an attorney being fully protected. Korean law also has a similar discovery process. Therefore, Korean law should provide protection so as to assure attorney-client privilege and work-product immunity. Of course there are laws that protect attorney-client communication and work product, similar to attorney-client privilege and work-product immunity. However, these laws do not provide sufficient protection, and theories concerning them have not been discussed thoroughly. Recently a Korean district court prohibited the use of a seized written opinion of a lawyer as evidence, mentioning attorney-client privilege. As in the case stated above, theories concerning US attorney-client privilege and work-product immunity should be used to supplement Korean law.
