보험을 통한 환경오염손해 배상책임위험의 전가

이 글은 환경오염위험의 관리와 피해구제를 위한 효과적 대안으로 환경오염배상책임보험이 과연 유용한 수단이 될 수 있는가는 의문에서 연구되었다. 헌법상 환경권에 근거하여 환경정책법과 환경오염손해에 대한 개별 입법을 통해, 환경오염손해의 구제가 이루어지고 있으나, 민사소송절차나 환경분쟁조정제도를 통해 이루어지고 있다는 점과, 배상책임의 이행에 대한 재정적 보증제도가 규정된 환경책임법이 존재하지 않는다는 문제점이 지적된다. 피해자에 대한 재정적 보증제도로는 환경기금의 조성, 환경배상책임보험제도나 공제제도를 활용하는 방법 등이 고려될 수 있지만, 이글에서는 환경오염배상책임보험제도를 통한 구제방법의 효율성에 한정하여 살펴보았다. 환경오염손해의 개념과 특성, 현행법상의 구제방법을 살펴보고, 환경오염손해가 보험으로 담보할 수 있는 성격의 위험인지를 분석하였다. 다음으로 어떤 성격의 보험으로 담보할 것인지의 문제와 보험을 통한 환경오염손해 배상책임위험의 전가가 피보험자 보호 및 피해자 구제에 도움을 주는 녹색성장시대에 가장 부합하는 정책적 대안이 되기 위한 전제조건을 제시하였다.
Abstract
The purpose of this study is to yield the adoption of environmental liability system and environmental impairment liability insurance in Korea. Currently, two legal remedies address damages to the environment. First, there is measure pertaining to the domain of Public Law such as administrative litigation and the system of "Environmental Dispute Resolution". Second, there are procedures under Private Law such as civil action. However, a crucial issue remains unresolved, for a majority of said measured depend on civil litigation and no prescript such as an environmental liability law has been formulated. Chapter 1 provides the background and necessity of this study. Chapter 2 defines the concept of environmental liability and survey what kinds of remedies according to the law now in force. Chapter 3 examined whether the risk of environmental impairment liability is insurable risk ; focus on pure risk, uncertainty, chance of occurrence and possibility of estimating the damage. Chapter 4 examined how to institutionalize environmental impairment liability insurance. In conclusion, Chapter 5 forwards the operative direction for this insurance.
