고령자의 주거안정 확보를 위한 終身型 建物賃貸借제도의 개발에 관한 입법론적 연구

This study considered legally on the housing stability of the aged in our country, especially on the development in lifetime rental system of being faced in the ultra aged society. In our country's housing market, the housing security of the aged is being placed in the very poor position as for the qualitative condition of housing and the easiness in housing security when comparing it with the non-aged. Accordingly, this study considered sociologically and legally by having a prior research especially as 'the law pertinent to security of housing stability in the aged,' which was legalized in Japan, among the enacted contents related to the housing security of the aged. In particular, the legislation in Japan enough to be noted in the lease contract of the aged can be considered as 'lifetime lease.' Elderly people's lifetime lease is a system of solving the housing instability that the aged have and of protecting the stable housing environment during lifetime, namely, until death. The legislation of this lifetime rental-housing right led to what the device that the elderly single·married-couple households can dwell in the rental housing over lifetime came to continue to exist as far as an aged lessee is alive. Based on this study, the implication is expected to be possibly delivered to development in new rental system for the future aged in our country where the housing environment of the aged is very poor.
