현행법상 심신장애의 판단기준에 관한 논의

초록
비행청소년과 성인을 대상으로 범죄인의 재활을 통한 사회보호를 목적으로 하는 교정은 교육형주의를 지도이념으로 한다. 교육형주의의 효과적인 실현을 위해서는 교정대상자의 선정과 분류가 전제되어야 할 것이며 여기에는 형법 제10조 제1항과 제2항에서의 ‘심신장애’의 판단이 중요한 역할을 한다. 이에 현행법상 심신장애 판단기준에 관하여 해석상․입법상의 방향을 제시해 보면, 첫째 ‘심신장애’에 해당하는지를 판단함에 있어서 ‘정신장애’가 있는지 여부는 전문가에 의한 감정에 의하고, 이것을 토대로 법관이 ‘심신장애’에 해당하는지를 최종적으로 판단하는 것이 타당하고, 둘째 현재 추상적․일반적 조항의 형식으로 규정되어 있는 생물학적 요소를 법관, 정신의학자, 심리학자 등으로 구성된 협의체에서 충분한 논의를 거쳐 열거적으로 법률에 구체화하는 것이 바람직하다고 본다. 셋째 감정전문가의 감정의 의무성여부에 관해서는 책임무능력을 판단함에 있어서 생물학적 요소인 정신장애의 판단은 감정이 필수적이고, 심리학적 요소인 사물변별능력 내지 의사결정능력에 대한 감정은 임의적이라고 보아야 할 것이다. 마지막으로 감정의견의 구속성에 관해서 ‘심신장애’와 ‘정신장애’의 관계는 ‘정신장애’가 있는지 여부는 전문가에 의한 감정에 의하고, 이것을 토대로 법관이 ‘심신장애’에 해당하는지를 최종적으로 판단하는 것으로 이해하고, 생물학적 요소인 ‘정신장애’에 대한 전문가의 감정을 필수적인 절차로 파악한다면 이에 대한 전문가의 감정의견은 당연히 법관을 구속한다고 보는 것이 타당하다고 본다.
Abstract
The purposes of correction has been protecting the community through the rehabilitation of criminals and the major ideology of correction and welfare is the educational punishment. Effective realization of the educational punishment is based upon the promise selection and categorization of objects for the correction. The judgment of ‘psychological disorder' in the criminal law § 10 takes on important roles to select and classify objects for the correction. The conclusion of this paper is as in the following:The first, it is reasonable to judge ‘psychological disorder' that ‘mental disorder' should be judged by experts and on the basis of this results, a judge should finally decide ‘psychological disorder'. The second, it is desirable that biological elements to judge ‘psychological disorder' which have been provided abstractly in the current criminal law should take concrete shape as soon as possible. The third, experts’ examination are necessary to judge ‘mental disorder’' which is biological elements, but are voluntary processes to decide psychological elements. And it is nature that experts’ opinions about judgment of ‘mental disorder’ have carry binding force against judge.
