부패방지 관련법제의 체계 및 평가

초록
법치주의는 국민의 자유를 보장하기 위한 자유주의의 원리로서 발달한 것이며, 오늘날에도 권력분립주의와 함께 자유민주주의의 구성요소로 인정되고 있다. 부패는 시장의 건전성을 위협하고, 공정한 경쟁을 저해하고, 자원배분을 왜곡하고, 공공의 신뢰를 파괴하며, 법치주의를 저해한다. 인간이 아닌 법이 국가질서나 사회질서의 유지 및 형성을 위한 수단과 척도로서 기능하게 되는 법치주의하에서는 개별적 법률관계가 객관적이고 공정한 법을 토대로 하여 유지되어야 하는데, 법의 집행자와 수범자 당사자간의 담합에 의해 실정법에 반하거나 모순되는 행위를 하게 되면 법의 구속력은 더 이상 인정되지 못하기 때문이다. 즉, 부패행위는 법치주의를 부정하는 의미를 갖게 되기 때문에 부패방지문제는 법치주의의 위기극복차원에서 부패방지논의가 이루어져야 한다. 부패방지를 통하여 법치주의를 회복한다는 당위적 요청을 충족하기 위해서는 부패행위를 근절하지 못하는 현행 부패방지 관련법제의 문제점을 검토하는 것에서 출발하여야 한다. 현행법상 부패방지는 각 법령에 산재해 있는 것이 특징이자 문제점이라 할 수 있다. 부패방지 관련법제는 ① 헌법 ② 정치부패방지 관련법제, ③ 행정부패방지 관련법제, ④ 부패사정 관련법제, ⑤ 형사사법분야의 부패방지 관련법제 등으로 유형화할 수 있고 이러한 유형화에 따라 법현실적으로 쟁점이 되고 있는 사항을 중심으로 검토하였다. 궁극적으로는 현행 부패방지 관련법제의 통폐합 및 그에 따른 개별법의 정비가 필요하다. 부패방지 관련법제의 정비를 통하여 대통령을 비롯한 공직자의 청렴성과 도덕성이 헌법으로부터 발원되어 부패방지법, 공직자윤리법 등 부패방지 관련법제로 구체화되어 확고하게 공직사회에 뿌리를 내리고 궁극적으로 사회 전영역으로 확산되고 심화되어야 할 것이다.
Abstract
The rule of law has been developed as a principle of liberalism to ensure people's freedom, and it has achieved recognition as a component of liberal democracy with separation of powers. Anti-corruption issues should be discussed in terms of the rule of law to overcome the crisis, because corrupt practices stand for denying the rule of law. In current, the provisions of anti-corruption are scattered each current laws, and it seems to be characterized and come into question. Laws related to anti-corruption can be categorized to ① the Constitution ② political anti-corruption laws ③ administrative anti-corruption laws ④ corruption- inspection laws ⑤ criminal and judicial anti-corruption laws, and the laws has been reviewed according to the types above. Consequently, there is needed to consolidate laws related to anti-corruption, and therefore each laws should be modified. Thus, integrity and morality of public officials have risen from constitutional law, should be brought into shape as laws relevant to anti-corruption such as the Anti-Corruption Act, and the Act of Public Servant's Ethics, and should take root into the society of public servants firmly.
