독일 선거제도에서 무엇을 배울 것인가? ― 국회의원선거제도를 중심으로 ―
What Should We Learn from the German Election System? ― Focused on the Election System of Assemblymen ―

이 글은 독일의 국회의원선거제도에서 우리가 배울 수 있는 점이 무엇인가를 살펴보기 위하여 작성되었다. 우리나라 법제도는 독일법을 계수하였고 지금도 여전히 많은 영향을 미치고 있다는 점, 선거제도에서도 여러 가지 점에서 비슷한 점이 많다는 점, 비교적 안정되고 선진적인 정치제도를 가지고 있다는 점에서 우리가 배울 점이 많을 것이라고 생각되기 때문이다. 독일선거제도의 특징과 중요 내용들을 우리나라 제도와 비교 검토한 결과 다음과 같은 점을 제안하였다. 첫째, 선거운동의 자유를 확대하고 규제를 줄여야 할 것이라고 제안하였다. 이것이 우리 헌법의 가치를 실현하는 방향이라고 생각되기 때문이다. 둘째, 정당의 국회의원후보자공천제도의 민주화를 확보하는 규정을 도입할 것을 제안하였다. 이는 정당민주화를 통해 정치발전을 도모할 뿐 아니라 또한 헌법의 정당조항(제8조)의 의미를 실현하는 것이기 때문이다. 셋째, 비례대표의석 배분에 있어서 저지조항의 완화를 제안하였다. 소수정당의 의회진출을 확대함으로써 국민의 의사가 국정에 비례적으로 반영될 수 있도록 하기 위함이다. 그러나 독일과 같은 비례대표의석의 비율을 늘이는 점과 이중입후보제에 대해서는 소극적인 견해를 표명하였다. 현재 우리나라 정당들은 대단히 불안정할 뿐 아니라 국민들의 정당에 대한 불신도 대단히 높은 단계에서 안정된 정당정치를 전제로 하는 비례대표제의 확대는 바람직하지 않다고 생각하기 때문이다.
Abstract
This article is made for knowing what can we learn from the German system of parliamentary election. This is because we accepted German legal system, German legal system still influences Korean legal system, there are some similarities between both electoral systems, and Germany has relatively stable and advanced political system. I suggest as follows;First, freedom of electoral campaign should be enlarged and regulation reduced. Because this is the way to realize constitutional values. Second, democratization of procedure of party candidate nomination should be introduced. Because this is the method to promote the political development through democratization of the party and to realize meanings of the party clause of the Constitution. Third, threshold clause of the proportional representation system should be lowered in order to promote for minority parties to enter into the parliament. But I have negative opinion against extending the number of proportional representation members and to introduce the dual candidacy system. Because I think that our parties are very unstable and people do not trust parties.
