지방자치단체의 기업유치에 대한 조세법적 과제

초록
지방자치단체는 일자리 창출, 지역경제 활성화, 지역경쟁력강화 등을 위해서 수도권 소재 기업, 외국기업을 적극적으로 유치하고 있다. 현행 조세특례제한법, 지방세특례제한법 등에서는 지방자치단체의 기업유치에 유치에 대하여 조세 지원을 할 수 있는 제도적 장치를 마련하고 있다. 그런데 기업들은 지방자치단체의 기업유치에도 불구하고 지방으로 이전하는 것을 꺼려하고 있을 뿐만 아니라 해외로 이전하는 기업이 증가하고 있고, 특히 지방재정자립도가 낮고 지역경제가 열악하여 재정확충을 함에 있어서 지방자치단체가 국가에 의존하여 경향에 있다. 지방자치단체의 기업유치 활성화에서 주로 재정학적 관점에서 선행연구가 이루어 졌고, 조세법적 관점에서의 논의가 미흡한 실정이다. 따라서 현행 조세법상 지방자치단체의 기업유치에 대한 조세지원제도를 살펴보고, 기업유치에 따른 지방세수 증대, 일몰제도의 적정성, 특별교부세 강화, 조례에 의한 세제지원, 초과조례제정의 한계, 지방재정의 확충과 건전성 확보 등의 법적과제를 검토하여 기업의 지역으로의 이전 원활화, 지역주민들의 일자리 창출, 지역경쟁력 강화, 재정자립도 제고, 지역경제 활성화가 이루어지는 방안을 강구하였다.
Abstract
Local governments are actively trying to attract businesses in metropolitan area and foreign companies for creation of jobs, activation of local economy and strengthen of regional competitiveness. The current Restriction of Special Taxation Act and the Local Tax Exemption Statute have been provided institutional arrangements which the local governments can support tax to attract companies. However, despite the local autonomous entities’ efforts of business attracting, the companies avoid to move to local area but prefer to move out of country. Therefore, we are going to look the tax support system into the current tax law for local governments to attract companies and also looking for the ways such as creating jobs for local residents, strengthen of regional competitiveness, improving financial independence and the local economy to review the legal issues like the increasing of local tax according to investment, the adequacy of sunset law, strengthen the special grants issues, tax incentives by ordinance, the limits of exceeding the ordinance establishment, expansion of local finance and ensure the financial soundness etc.
