클라우드 컴퓨팅 환경에서의 개인정보의 미국 이전에 따른 문제점 및 대응방안 연구 - 미국 정부기관에 의한 개인정보 누출 위험을 중심으로-

The USA Patriot Act has significantly affected processes by which the government agencies obtain personal information from institutions. With the enactment of the Act, the government has much more able to access personal information because the procedures necessary for such access has been greatly compromised in favor of the government. More Koreans are likely to use clouds from American companies such as Google, Microsoft, or Amazon. com. Inevitably, Korean personal information will be likely to be stored in servers located in American soil. This will increase the risk of unwanted disclosure of personal information of Korean users by the U.S government. This paper suggests that more security measures be taken to protect personal information. Korean and the U.S. government may prepare a safe harbor framework to improve security of personal information. The Korean government (legislative or executive) may require personal information stored only in Korea. The government may impose more significant legal liability upon those institutions that use cloud services that stores information outside of Korea. Finally, the government may seek to strengthen overall security of personal information in response to the cloud computing environment.
