출입국관리 관련 통합법전 모델의 모색 - UK와 프랑스의 이민법을 참고하여 -

분야별로 각 기본법률과 개정법률들을 하나의 대주제로 묶어 통일된 법전을 편찬해 내는 프랑스의 法律公刊 방식은 물론 미국의 연방행정법전처럼 특정 분야의 통합법전도 가지고 있지 않은 대한민국의 법령체계에서는 간혹 법률과 그 하위 법령 간에 상호모순된 규정들이 발견되기도 하고 개별 법률 간에 상이한 내용을 담고 있는 규정들이 발견되기도 하는 등의 문제가 발생하여 해석상, 적용상 적지 않은 곤란을 일으키는 경우가 있다. 이민법 분야도 이에서 예외는 아닌데, 본고는 대한민국 이민법령들이 갖고 있는 체계상 문제점들을 지적하고 이에 대한 해결방식을 모색하기 위해 UK와 프랑스의 이민법 체계를 고찰한다. 우선 프랑스의 『외국인법전』에 대한 고찰로부터는 대한민국의 출입국관리법에 총칙의 제정이 절실히 필요하다는 것과 프랑스의 『외국인법전』에서처럼 가족재결합권에 관한 상세한 규정을 마련하여 우리나라 이민법의 내용적 흠결을 보완할 필요가 있다는 것이다. 다음으로 UK의 2009년 BCIA에 대한 비교고찰을 통해 이민법은 국적의 개념 대신 시민권이라는 개념에서 접근해야 될 필요성을 깨닫게 되었다는 점, 그리고 BCIA에서 시도하고 있는 이민법령 체계의 간소화 작업은 관할행정기관 간의 권한조정뿐만 아니라 행정쟁송에 있어 이에 대한 사법심사를 담당하는 법원의 관할에 대한 정비도 향후 점검이 필요한 사안임을 시사해 준다는 점 등도 본고의 고찰을 통해 얻은 결론의 일부라고 하겠다. 마지막으로 본고는 당장 통일법전의 형식을 취하기 어려운 기술적, 실무적 조건에 있는 우리나라로서는 그 차선책으로 그리고 또한 시급한 과제로서 UK 출입국관리국에서 현재 활용하고 있는 실무지침서를 모델로 한 「출입국관리법 매뉴얼」(가칭)의 편집ㆍ제작을 제안한다.
Abstract
With considerable increase of immigration population, it becomes more important than ever to have a well-established system of immigration laws. Nevertheless, the actual legislation in South Korea reveals many problems, including those that are raised, when we try to make harmonized interpretations between relevant laws and regulations and execute them. As a possible solution to these inconveniences, this paper proposes to unify immigrations laws and regulations into the form of code, for the model of which we can refer to French and UK legislations. The Code de l'entrée et du séjour des étrangers et du droit d'asile of France and the Borders, Citizenship and Immigration Act 2009 of UK present a model of unified code of immigration laws and regulations so much as to contain almost all the articles related to immigration control and serve as a true reference for immigration officers. For technical reasons with regard to Korean way of legislation and practices, this paper proposes in conclusion a manuel of instructions and guidance for immigration officers to constantly refer to, which will help make the enforcement acts done in the limits of constitution and laws.
